If these issues cannot be satisfactorily resolved, I <br />will have to terminate the purchase agreement for the referenced property. According to the Purchase <br />Agreement, March 1, 2017 is the date on which the Feasibility and Inspection Period ends. <br />Following are some but not all of the concerns that I have at this time: <br />Rice Creek Watershed District Permit Application Number 16-116 (the "Application") <br />The City of Centerville is identified as "Applicant'. The City of Centerville (the "City") is also the <br />current owner of the Property. My expectation is that the City is responsible for satisfying all <br />requirements the Rice Creek Watershed District ("RCWD") has imposed or may impose on the owner of <br />the Property in order for the RCWD to issue all the permits and approvals I will need from the RCWD to <br />build the improvements I have planned on the Property. The City's obligation to maintain stormwater <br />facilities shall continue after a sale of the Property to me closes. These maintenance obligations pertain to <br />stormwater drainage facilities that serve the Property that I intend to purchase but also other properties as <br />well. I hereby request copies of all existing maintenance agreements that the RCWD has specified in <br />order to grant the permits and approvals I need to construct my planned improvements. <br />For example, paragraphs 4. And 5. in the Administrative section describe obligations to memorialize <br />responsibilities for stormwater facilities that the City must submit. <br />In the Findings section of the Application, Paragraph 2. Stormwater — "As -built records of the <br />stormwater pond were submitted for the NURP pond in 2008 verifying that the pond was conshucted to <br />Plan , however applicant must submit evidence of maintenance or arrange to maintain the pond during the <br />construction process. Based on District MDAX the bio-filtradon basins were constructed, however as- <br />builts must be provided to confirm the size. An acceptable maintenance obligation must be submitted (see <br />Finding 7for additional details).
