B. The Parties agree the Subject Property contains a building that is the former site <br />of the "Vaterworks" restaurant. That building is in danger of collapse and poses a hazard to <br />public safety or health. Moreover, the structure is unsigidy and a public nuisance. <br />C. On July 25, 2016, the City Budding Official deemed tate old "Waterworks" <br />building "Hazardous." "Hazardous" as did by M rinesota Statute Section 463.15 is any <br />building or property, Which because of inadequate maintenance, dilapidation, physical damage, <br />unsanitary oonditicm, or abandonment, constitiaes a fire hazard or a hazard to public safely or <br />heaifh. The Patties agree that this structure meets this standard as a hazardous building. <br />D. During 2016 and 2017, the City and Property Owtror wmit ed together sttr�o� <br />to allow Property Owner to demolish the hazardous building as part of redeveloping the entire <br />Subject Property. Unfargmsdy, rade°velopment efforts have stalled with no ideniffiable <br />timefimme for demolition of the hazardous budding. During this period, the condition of the <br />building has continued to deteriorate. The Property Owner was not able to remediate tine <br />hazardous building or make it safe. <br />E. In January 2016, the Centerville City Council directed the City Attorney to seek <br />judicial autbori zadon to demolish the hazardous building and make the Subject Property safe. <br />F. The Property Owner seeks to demolish the hazardous building and make the <br />Subject Property safe white also avoiding costs associated with litigation. He asks the City to <br />stay litigation m order to avoid manning litigation that would uI moately become a east <br />asse+d against the Subject Property. In exchange, he asks City to enter into this Consent <br />Decree and the other Agreements found in this went. <br />NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL <br />COVENAAiM THE PARTM BERETO AGREE AS FOLLOWS: <br />L The Property Owner agrees to demolish and moire safe, the former lite of the <br />"Watserwode restaurant. The Property Owner shall snbsfartmUy begin ffic demolition process <br />on or befoa+e May 1, 2017. The Property Owner shall complete the demolition pnaoeas and make <br />the Subject Property safe and comply with health, safety and mtisence laws, on or before July 1 <br />2017. <br />2, <br />
