II. The City Building Official will inspect and judge whether the afore.n rationed <br />deadlines have been mei. In addition, the City Buitdmg Official will inspect and judge whAer <br />hazardous conditions and musaaces on the Subject Property have been adequately remediated <br />and therefore comply with City Ordinances, the State Building Code, or any other applicable law <br />or regulation. it shall be his decision, and his decision alone, which shall govern the decision as <br />to whether conditions on the Subject Property comply with applicable laity or regulation <br />III. If the aforementioned deadlines are not met, or the Subject Property does not <br />comply with health, safety or nuiance kwon the Property Owner gives the City permission, and <br />grants the City the legal right to enter the Subject Property, without a warrant or intervention <br />from a court, to remediate all hazmdoas*oandidons and nuissnees found on the Subject Property. <br />This document serves as the Property Owner's written consent for this purpose pursuant to <br />Amita Statute Section 463.151. <br />IV. In addition to allowing the parties to agree to correct haza*s editions and <br />mAsances on the Subject Property, Mirmesota Statute Section 463.151, allows the City to asses <br />those costs ag hyx the Subject Property. Towarads this goal, the Property Owner aclmowledges <br />and agrees to reimburse the City for the cost of the remediation of the hazardous editions and <br />xndsmaoes on the Subject Pmperty. Costs include the actual rwmdiation work and the assodated <br />cngm==& legal and admuristcative costs. In the event that amount is not paid within thiriy- <br />days from the data an invoice is tandere4 the Property Owner agmx, and the City shall apply <br />this amount as a special assessment to the Subject Property, as sex facto below. <br />V. The Property Owner acknowledges that he grants the rights and moons <br />contained is this dost to the City herein knowing that he bas certain legal rights and <br />privileges. He, agrees to waive those rights and privileges upon. cratering Indo this Consent Decree <br />and Agreement. The Property Owner has had adequate time to consult with legal comsei about <br />his rights and privileges, and does knowingly waive those ngW and privileges.
