AND <br />THE crry OF MINNESOTA <br />WHEREAS, the Anoka County Fire Protection Council (hereinafter "ACFPC") operates as an <br />independent Joint Powers Arraignment between multiple jurisdictions in Anoka County <br />organized under Minn. Stat. 471.59 , and <br />WHEREAS, the stated purpose of the ACFPC is to join together to improve the efficiency and <br />effectiveness of fire and emergency services to the public within the geographic service area of <br />the member jurisdictions to cooperatively address its member's long term needs for fire -fighting <br />and emergency equipment, fire records data systems, fire-fighter and EMS training, fire <br />prevention, fire inspection, fire -related public education, and other fire and emergency related <br />essentials; and <br />WHEREAS, the ACFPC desires to work cooperatively with its member cities to develop and <br />implement fire protection related training through the ACPFC Fire Training Academy, and <br />WHEREAS, the City of (hereinafter "City") is a member of ACFPC; and <br />WHEREAS, the ACFPC, wishes to obtain the assistance and services from member cities of <br />their qualified firefighter personnel that have been trained in various aspects of providing fire <br />protection/ emergency responder services, and to utilize these individuals to provide training as <br />instructors (hereinafter "Instructors") at the ACFPC Fire Training Academy. <br />NOW THEREFORE, THE ANOKA COUNTY FIRE PROTECTION COUNCIL AND THE <br />CITY OF 'MUTUALLY UNDERSTAND AND AGREE THAT: <br />1. If requested by ACFPC, the City shall coordinate with ACFPC to provide Instructors certified <br />in certain areas of fire protection/ emergency responder training for the purpose of conducting <br />training sessions or seminars. The City shall have the final authority whether to approve or deny <br />the request by ACFPC for a certain Instructor for the requested training session or seminar. <br />2. The Instructor at all times shall remain a [volunteer] [paid on call] [full time] firefighter with <br />the City. As such, the Instructor will continue to be paid by the City for the training time at the <br />firefighter's standard training related pay in accordance with the City pay policies for conducting <br />such training sessions or seminars. The City shall be expressly responsible for the payment of <br />any applicable benefits to the Instructor, and shall cover all of the cost for maintenance or repair <br />of any of its own equipment. <br />3. The Instructor shall at all times conform to the City's administrative and personnel policies, <br />or other applicable rules and regulations of the Fire Training Academy. <br />M <br />
