Such plat shall contain all easements required for the construction of improvements for the <br /> development. <br /> 3. RIGHT TO PROCEED. Within the Plat or Land to be platted,the Developer <br /> may not grade(except as authorized in a Grading Permit issued by the City or the Final Grading <br /> Plan,hereinafter defined) or otherwise disturb the earth, remove trees, construct sewer lines, <br /> water lines, streets, utilities, public or private improvements, or any buildings until all the <br /> following conditions have been satisfied: 1)this Agreement has been fully executed by all <br /> parties, including owners and mortgage holders, and filed with the City Administrator,2)the <br /> necessary security has been received by the City,3)the Plat has been submitted for recording <br /> with the Anoka County Recorder's Office, and 4)the City Administrator has issued a letter that <br /> all conditions have been satisfied and that the Developer may proceed. The Plat will not be <br /> released to the Developer and may not be recorded until the necessary security has been received <br /> and accepted by the City. The City Administrator shall issue the notice to proceed within seven <br /> (7)business days after receipt and acceptance of the security. <br /> 4. OTHER DEVELOPMENT. The City may refuse to approve future planning or <br /> zoning applications,plats or development contracts by or with Developer if Developer has <br /> breached this Agreement and the breach has not been remedied. <br /> 5. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of <br /> this Agreement,no amendments to the City's Comprehensive Plan or official controls shall apply <br /> to or affect the use, development density, lot size, lot layout or dedications of the approved Plat <br /> unless required by state or federal law or agreed to in writing by the City and the Developer. <br /> Thereafter, notwithstanding anything in this Agreement to the contrary,to the full extent <br /> permitted by state law the City may require compliance with any amendments to the City's <br /> vxG-2017-11-03 Page 2 <br /> 17 <br />
