City of Centerville <br /> Council Meeting Minutes <br /> October 25,2017 <br /> Interim City Administrator Larson stated that he had invited Mr. Rehbein to the Council meeting <br /> to review compliance with his Interim Use Permit. Interim Larson stated that the City has <br /> concerns regarding: material tracking into the street, the amount of soil being stored on the site, <br /> material complying with the permit (granular and compactable or black dirt), restoration of the <br /> area around the cul-de-sac and access from Fairview Avenue, and the submittal of a Surface <br /> Water Management Plan (SWPPP). Engineer Statz stated that several months prior Mr. Rehbein <br /> was asked for information regarding soils and Mr. Rehbein's own Soils Engineer stated that the <br /> soils needed to be blended with additional materials and dried before they could be compacted to <br /> meet specification for building site soils. He also stated that Mr. Rehbein has received numerous <br /> letters from the city requesting that he file a SWPPP, which is specifically required by the NP. <br /> even though RCWD and the MPCA did not require one. <br /> Interim Administrator Larson stated that since the distribution center has been constructed, 21st <br /> Avenue was extended past the site, hauling to the site has been modified with the driveway being <br /> significantly shorter, allowing for soils to be tracked into the roadway. Mr. Rehbein has been <br /> receptive to requests for cleaning; however the City would prefer that has was proactive <br /> regarding the necessities of cleaning and initiate this requirement without the City's contact. He <br /> also stated that the current IUP is set to expire on December 31, 2018 and that any remaining <br /> material must be hauled away or graded and seeded, not later than December 31, 2019. If the <br /> material that was brought to the site is sub-standard soil, there is a potential for a large liability to <br /> remove substandard soil. It was suggested that the owner provide bond or letter of credit to <br /> ensure that the site is completed to the City's requirements when the IUP expires. <br /> Discussion ensued regarding United Properties' option to purchase all of the Rehbein property <br /> and the potential for them to use the soils. <br /> Mr. Rehbein addressed Council stating that he has completed other requirements of the IUP and <br /> feels that a SWPPP is not required as two outside entities have stated that they do not require <br /> such a document and his unwillingness to complete this requirement which could cost $10,000. <br /> He insisted that the soil will be removed next year, as several housing projects will commence in <br /> nearby locations and utilize the soils for building pads. Mr. Rehbein stated that he has not <br /> received complaints from residents nor has the City. He mentioned that his property is being <br /> taxed as a commercial operation so that his taxes are high on the property. He also stated that he <br /> has kept a 50' buffer from the creek and installed silt fencing. <br /> Discussion ensued regarding United Properties' damage to Fairview Street due to construction of <br /> the distribution center and their liability for same. City Attorney Glaser stated that this is being <br /> handled with them. <br /> Engineer Statz stated that the City has been contact by the City of Lino Lakes regarding the <br /> SWPPP and cleaning of the roadway. Mr. Rehbein stated again that he has never been contacted <br /> regarding cleaning of the roadway. <br /> Mr. Rehbein stated that if Council desired for the soils to be gone by the summer there is a good <br /> possibility for it to be removed by June of 2018. <br /> Page 2 of 7 <br />
