The City shall compensate the Contractor for Collection of Garbage, Refuse, and <br /> Recyclable Materials upon the basis of the total number of occupied Dwelling Units <br /> serviceable, less any employees of the Contractor that are eligible for free service as part <br /> of the Contractors employment policy, and less any residences that have service <br /> voluntarily "Suspended" for greater than one month as defined in this agreement. <br /> Contractor shall provide a monthly report of any "Suspended" service locations. <br /> 3. Periodic additions or deductions in the number of Dwelling Units collected shall be subject to <br /> verification and agreement between the City and the Contractor. Such adjustments may not be <br /> made more often than once per month. <br /> 4. During the period of the Contract, the City shall pay to the Contractor, on or before the 30th of <br /> each month, for Garbage, Refuse, and Recyclable Material Collection performed by the <br /> Contractor during the preceding calendar month. The amount due shall be the number of stops <br /> multiplied times the quoted rates for that month. The rate quoted for each year shall be in effect <br /> from July 1 of that year to June 30 of the subsequent year. <br /> H. Insurance <br /> Prior to the commencement of a Contract, copies of all required insurance policies shall be submitted to <br /> the City for review. The Contractor agrees to remain fully insured during the course of a contract as <br /> follows: <br /> 1. Comprehensive general liability insurance including premises - operations coverage, completed <br /> operations coverage, independent contractor's coverage and contractual liability coverage, covering <br /> the indemnity requirement set forth herein, with limits not less than $2,000,000 combined single <br /> limit, including bodily injury liability and property damage liability. <br /> 2. Workers' compensation insurance and employers'liability insurance as required by law. <br /> 3. Comprehensive automobile, bodily injury and property damage, liability insurance, including <br /> coverage for all owned and hired vehicles and employers'non-ownership liability coverage. Limits of <br /> liability should be for not less than $2,000,000 combined single limit bodily injury and property <br /> damage liability. <br /> 4. The Contractor shall name the City as an additional insured on such insurance and shall furnish <br /> evidence of the same to the City. <br /> 5. The policy shall be a standard form policy provided for by a carrier approved by the State of <br /> Minnesota and shall not contain any exclusion that will restrict coverage on any operations performed <br /> by this Contractor or any subcontractors thereof. <br /> 6. The policy or policies shall afford contractual liability coverage to provide coverage for the <br /> indemnification requirement set forth herein. <br /> 7. It shall be a condition of a Contract that the policy or policies waive any or all governmental <br /> immunity as a defense in any action brought against the insured or any other party to the Contract. <br /> 8.
