All employees of the Contractor shall be dressed in clean uniforms, which provide suitable <br /> identification of the Contractor. <br /> 8. The Contractor shall provide walk-up service for elderly and disabled residents that are approved by <br /> the City at no extra charge. <br /> F. Required Contract Provisions <br /> 1. The Contractor shall provide access to the City, Anoka County, or any of their duly authorized <br /> representatives to review any books, documents, papers, and records of the Contractor which are <br /> directly pertinent to this contract for the purpose of making an audit, other examination and preparing <br /> excerpts and transcriptions. <br /> 2. The work shall be done with forces that are adequate to ensure the satisfactory collection and disposal <br /> of said materials at all times. Failure to perform shall not be excused by adverse weather, breakdown, <br /> or similar hindrances,which for other work might be regarded as "acts of providence". <br /> 3. Minnesota State Statutes, Section 181.59, which prohibit discrimination on account of race, creed, or <br /> color in the performance of public contracts, is made a part of this request with the same force and <br /> effect as if set out herein verbatim. <br /> 4. The contractor shall be an independent contractor and not affiliated with the City and are not City <br /> employees. <br /> 5. The Contractor shall defend, indemnify and hold harmless the City, its officers, agents, <br /> representatives and/or employees, from and against all claims, damages, losses, costs or expenses, <br /> including reasonable attorney fees, which may be asserted against the City or for which it may be <br /> held liable, to any extent resulting from the negligence or willful misconduct of the Contractor, its <br /> employees, agents, representatives,or subcontractors, in the performance of the Contract. <br /> F. Payment: Option 1 at discretion of City: Contractor Bills and Collects for service cost, City collects <br /> delinquent accounts. <br /> Contractor shall establish customer accounts in its own billing system and issue periodic bills to all <br /> residents covered by this contract. Contractor's delinquent account listing on September 1 of each <br /> year shall be supplied to the City for certification to Anoka County and collection with real estate <br /> taxes. Past experience shows approximately 35 accounts valued at$7-$8000, could be expected each <br /> year. Contractor will receive 90%of the unpaid accounts value,the city will issue payment by <br /> January 31, following receipt of the delinquent account listing. The discount will be retained by city <br /> as reimbursement for its costs of collection. <br /> G. Payment: Option 2 at discretion of City: City Bills and Collects for service cost on utility bills. <br /> a. The City shall compensate the Contractor for Collection of Garbage, Refuse, and Recyclable <br /> Materials upon the basis of the total number of occupied Dwelling Units serviceable, less any <br /> employees of the Contractor that are eligible for free service as part of the Contractors <br /> employment policy, and less any residences that have service "Suspended"as defined in this <br /> agreement. Contractor shall provide a monthly report of any "Suspended" service locations. <br /> b. Periodic additions or deductions in the number of Dwelling Units collected shall be subject to <br /> verification and agreement between the City and the Contractor.
