1.15 "Limited Assessment" shall mean and refer to an assessment levied by the <br /> Association against fewer than all of the Units in the Association pursuant to <br /> Section 6.1, below. <br /> 1.16 "Limited Common Elements" Limited common elements include: 1) portions <br /> of the common elements that are designated for the exclusive use of the unit <br /> owners of the unit or units to which the limited common elements are allocated, <br /> and 2) fixtures or improvements located wholly or partially outside a unit's <br /> boundaries, that serve one or more but fewer than all of the units, and shall be <br /> allocated solely to the unit or units served. Limited Common Elements are <br /> subject to the rights granted to the Association herein or in a separate recorded <br /> easement, including the Association's right to improve, inspect, use, repair, <br /> replace, maintain and regulate. The Limited Common Elements are further <br /> described in Section 3.2, below. <br /> 1.17 "Member" shall mean all persons who are members of the Association by virtue <br /> of being Owners as defined in this Declaration. The words "Owner" and <br /> "Member" may be used interchangeably in the Governing Documents. <br /> 1.18 "Occupant" shall mean any person or persons, other than an Owner, in <br /> possession of or residing in a Unit. <br /> 1.19 "Owner" shall mean and refer to the record owner, whether one or more persons <br /> or entities, of the fee simple title to any Unit except that if(i) a Unit is being sold <br /> in a contract for deed, (ii) the contract vendee is in possession of the Unit and (iii) <br /> the contract so provides, then the vendee and not the vendor shall be deemed the <br /> "Owner". <br /> 1.20 "Person" shall mean a natural individual, corporation, limited liability company, <br /> partnership, trustee, other or legal entity capable of holding title to real property. <br /> 1.21 "Plat" shall mean the plat of Peltier Estates, recorded in the offices of the County <br /> Recorder or Registrar of Titles, Anoka County, Minnesota, and any amendments, <br /> supplements and additions thereto, and replats thereof. <br /> 1.22 "Property" shall mean all of the real property submitted to this Declaration, <br /> which is legally described on Exhibit A, attached hereto, and including the <br /> Dwellings and all other structures and improvements located thereon now or in <br /> the future. <br /> 4 <br /> 022818 <br />
