a. Use of a Dwelling for model and sales office purposes; <br /> b. Storage of equipment, materials or earth during the construction of new <br /> Dwellings on Units owned by the person doing such storage or <br /> construction; and <br /> C. Display of signs advertising Units in the Property as allowed by the City. <br /> SECTION 8 <br /> ARCHITECTURAL CONTROL <br /> 8.1 Restrictions on Alterations. The following restrictions and requirements shall <br /> apply to alterations on the Property: <br /> a. Except as expressly provided in this Section 8, no structure, building, <br /> addition, deck, patio, fence, wall, enclosure, window, exterior door, sign, <br /> display, decoration, color change, shrubbery, material topographical or <br /> landscaping change, nor any other exterior Improvements to or alteration <br /> thereof, or alteration of any Dwelling or any other part of a Unit which is <br /> visible from the exterior of the Unit (collectively referred to as <br /> "alterations"), shall be commenced, erected or maintained in a Unit, unless <br /> and until the plans and specifications showing the nature, kind, shape, <br /> height, color, materials and locations of the alterations shall have been <br /> approved in writing by the Architectural Control Committee, described <br /> below. <br /> b. The Architectural Control Committee (the "ACC") shall consist of three <br /> (3) members. The Declarant shall have the exclusive authority to appoint <br /> and remove the members of the ACC for a period of time extending until <br /> Declarant voluntarily surrenders such control. Specifically, Declarant's <br /> right to control the ACC may extend beyond Declarant's Control Period <br /> over the Association, as described in Section 4.5, above. After the <br /> Declarant has surrendered control over the ACC, the committee members <br /> shall be appointed and removed by the Board of Directors. At any time, if <br /> no ACC is in existence, the Board of Directors shall serve as the ACC. <br /> All references in the Declaration to the ACC shall apply to the Board of <br /> Directors, if no ACC is in existence. In addition, Declarant's written <br /> consent shall be required for alterations until such time as there are no <br /> Units owned by Declarant or a Homebuilder, Declarant no longer has the <br /> right to add Units, and Declarant has voluntarily turned over control of the <br /> Association. <br /> 19 <br /> 022818 <br />
