City of Centerville <br /> Council Meeting Minutes <br /> July 25,2018 <br /> 1. Variance Request for 1965 South Robin Lane <br /> a. Findings of Fact <br /> b. Res. #18-010—Authorizing Variance <br /> Administrator Statz stated that the property and development are very unique with smaller lots <br /> due to the R-4 zoning. He stated that the City Code requires a 5' setback for a driveway from the <br /> lot line and a minimum of a 9' wide driveway. He also reported that the City did allow for the <br /> construction of an accessory structure on the rear of the property. He stated that a Public <br /> Hearing was held at the Planning & Zoning level and they recommended the Findings of Fact <br /> and Council's approval of granting a variance. <br /> Discussion ensued regarding the parcel abutting Royal Meadows Park where the driveway would <br /> be constructed, reasonable use of the property, location of utilities and a minimal encroachment <br /> of 2' into the setback. <br /> Mr. Doug Kruse, owner of 1965 South Robin Lane, stated that the City granted the permit for an <br /> accessory structure and at the time did not think there would be a problem with the installation of <br /> a driveway to it. <br /> Council Member Koski stated that there was healthy discussion at the P & Z level prior to <br /> granting their recommendation. <br /> Discussion ensued regarding the City's ability to access the drainage/utility easement areas on <br /> the property and that the City's rights along with the homeowner's rights are protected with the <br /> variance and its recording on the deed. <br /> Motion by Council Member Koski, seconded by Council Member King to Approve the <br /> Variance Request as Submitted. <br /> Discussion ensued regarding the need to include the approval of the Findings of Fact and Res. <br /> #18-010—Authorizing Variance. <br /> Council Member Koski included a friendly amendment to his motion including the <br /> Findings of Fact and Adoption of Res. #18-010 —Authorizing Variance. Council Member <br /> King seconded. All in favor. Motion carried. <br /> 2. Special Assessment Agreement—1299 Mound Trail <br /> Attorney Glaser stated that Council previously discussed municipal water connection deadlines, <br /> motioned to include three circumstances which would require immediate connection; sale of the <br /> home, increasing the square footage of the home by 33% or repairs of the existing well in excess <br /> of $1,500. He stated that with the change in ownership of 1299 Mound Trail the seller and <br /> buyer's title company negotiated with the City to be allowed to enter into an agreement for <br /> financing/escrowing the pending assessment dollar amount with the City having the ability to <br /> make the connection on their behalf if they fail to do so within four (4) months of purchase.
