DEVELOPMENT & SUBDIVISION AGREEMENT <br /> Bay View Villas <br /> THIS DEVELOPMENT & SUBDIVISION AGREEMENT ("Agreement") effective <br /> October , 2018, by and between the CITY OF CENTERVILLE, a Minnesota municipal <br /> corporation ("City"); and RICHARD A. DEFOE AND KARNA J. DEFOE, a married couple, <br /> (the"Developer"). <br /> 1. REQUEST FOR PLAT AND DEVELOPMENT APPROVAL. The Developer <br /> has asked the City to approve a final plat for the BAY VIEW VILLAS (referred to in this <br /> Agreement as the "Final Plat"). The land ("Land") is situated in the County of Anoka, State of <br /> Minnesota, and is legally described on the attached Exhibit A, including easements described <br /> therein. The Final Plat consists of 18 detached townhomes, governed by a Planned Unit <br /> Development (PUD) and a Conditional Use Permit, with one lot outside of the PUD containing <br /> an existing single family home. The PUD also includes Outlots for common areas. <br /> 2. CONDITIONS OF PLAT AND DEVELOPMENT APPROVAL. This <br /> Agreement serves as the Master Agreement for the development of the BAY VIEW VILLAS. <br /> The Plat will be developed in accordance with the Development Plans, Planned Unit <br /> Development and Conditional Use Permit. <br /> Version for Council Packet - 10/19/2018 Page 2 <br /> 68 <br />
