At such time as the City approves the final Plat, and the Developer furnishes the security <br /> required, the Developer may record the Plat with the County Recorder or Registrar of Titles <br /> within one hundred (100) days after the execution of this Agreement. If the final Plat is not <br /> recorded within the one hundred (100) days, the approval of the Plat is void, unless a written <br /> request for an extension is submitted to the City Administrator before the one hundred (100) <br /> days expire. The extension will be approved or denied by the City Council by placement on their <br /> agenda within fifteen (15) days of request for same. Such Plat shall contain all easements <br /> required for the construction and maintenance of improvements for the development. <br /> 3. RIGHT TO PROCEED. Within the Final Plat or Land to be platted, the <br /> Developer may not grade (except as authorized in a Permit issued by the City) or otherwise <br /> disturb the earth, remove trees, construct sewer lines, water lines, streets, utilities, public or <br /> private improvements, or any buildings until all the following conditions have been satisfied: 1) <br /> this Agreement has been fully executed by all parties, including owners, lessors, lessees and <br /> mortgage holders, and filed with the City Administrator, 2) the necessary security has been <br /> received by the City, 3) the Plat has been approved by the City Council and is in a form ready for <br /> recording with the Anoka County Recorder's Office, 4) the necessary easements or rights-of- <br /> ways have been recorded, and 5) the City Administrator has issued a letter that all conditions <br /> have been satisfied and that the Developer may proceed. The Final Plat will not be released to <br /> the Developer and may not be recorded until the necessary security has been received and <br /> accepted by the City. The City Administrator shall issue the notice to proceed within seven (7) <br /> business days after receipt and acceptance of the security. <br /> 4. OTHER DEVELOPMENT.
