8. PERMITS. The Developer shall obtain, or require its contractors and <br /> subcontractors to obtain, all necessary permits. Those permits obtained by Developer to begin <br /> work include, but are not limited to: <br /> A. Minnesota Pollution Control Agency (MPGA) — National Pollutant Discharge <br /> Elimination System (NPDES) Permit for Stormwater Discharge related to <br /> Construction Activity <br /> B. Rice Creek Watershed District— General Permit for Development Activity <br /> C. City of Centerville - Building Permit for home construction <br /> D. City of Centerville— Grading Permit for land disturbing activities. <br /> E. City of Centerville — Work within the Right-of-Way Permits for small utilities <br /> such as gas,phone, electric, cable TV. <br /> F. Anoka County Highway Department Permits for Work within the Right-of-Way <br /> G. MPCA Sanitary Sewer Extension <br /> H. MN Department of Health Water Main Extension <br /> L FEMA Letter of Map Amendment based on Fill (LOMA-F) <br /> J. Department of Natural Resources (DNR) - Work within the Ordinary High Water <br /> Mark <br /> 9. TIME OF PERFORMANCE. The Developer shall install all required public <br /> improvements ("Public Improvements") in the Plans with the exception of the final wear course <br /> of asphalt by December 31, 2019. The Developer may, however, request an extension of time <br /> from the City. If an extension is granted, it shall be conditioned upon updating the Security <br /> posted by the Developer to reflect cost increases and the extended completion date. <br /> 10. LICENSE. The Developer hereby grants the City, its agents, employees, officers <br /> and contractors a license to enter the Land to be platted to perform all work and inspections <br /> deemed appropriate by the City in conjunction with the Plat development and the Improvements. <br /> 11. EROSION CONTROL. The erosion control shall be implemented by the <br /> Developer according to the Storm Water Pollution Prevention Plan and Grading Plan, and <br /> inspected and approved by the City. The City or Rice Creek Watershed District may impose <br /> additional erosion control requirements if field conditions warrant. The parties recognize that <br /> time is of the essence in controlling erosion. If the Developer does not comply with the erosion <br /> control plan and schedule or supplementary instructions received from the City or the Rice <br /> Creek Watershed District, the City may take such action as it deems appropriate to control <br /> Version for Council Packet - 10/19/2018 Page 6 <br /> 72 <br />
