erosion. The City will designate a contact person responsible for erosion control issues. The <br /> contact person will attend the pre-construction meeting. Except in case of emergency, the City <br /> will give 48-hours notice to the Developer in advance of any proposed action, but failure of the <br /> City to do so will not affect the Developer's and City's rights or obligations hereunder. If the <br /> Developer does not reimburse the City for any cost the City incurred for such work within thirty <br /> (30) days, the City may draw down on the Security or Additional Security to pay any costs. No <br /> development, utility or street construction will be allowed and no building permits will be <br /> issued unless the Developer is in full compliance with the approved erosion control plans. <br /> The Developer shall require all contractors and subcontractors working on the Project to <br /> comply with City's erosion control standards. Those contractors and subcontractors are to be <br /> educated on the City standards how they may be required to post surety to secure performance. <br /> The City will work cooperatively with the Developer in securing their compliance with erosion <br /> control standards through the building permit process. <br /> 12. GRADING PLAN. The Plat shall be graded in accordance with the Grading <br /> Plan. Within thirty (30) days after completion of the grading and before the City releases any <br /> Security, the Developer shall provide the City with an "as constructed" grading plan certified by <br /> a registered land surveyor or engineer, with elevation shots showing that all ponds, swales, <br /> emergency overflows and ditches have been constructed in accordance with the approved <br /> grading plan. Developer shall verify lot corner elevations, pond depth, storm water ingress, and <br /> building pads. The City will withhold issuance of building permits until the approved certified <br /> grading plan is on file with the City and all erosion control measures are in place as determined <br /> by the City Engineer. The Developer shall be required to maintain all erosion control measures <br /> until written termination of the NDES permit is issued by the City. <br /> 13. DEWATERING. Due to the variable nature of groundwater levels and storm <br /> water flows, it will be the Developer's and the Developer's contractors and subcontractors <br /> responsibility to satisfy themselves with regard to the elevation of groundwater in the area and <br /> the level of effort needed to perform dewatering and store flow routing operations.
