CITY OF CENTERVILLE <br /> REQUEST FOR <br /> COUNCIL ACTION Verville <br /> Agenda Item# Department: Requested Council Meeting Date: <br /> Administration/Legal November 28, 2018 <br /> TITLE OF ISSUE: <br /> Southern Rail Liquor License Compliance Check <br /> BACKGROUND AND SUPPLEMENTAL INFORMATION: <br /> The police department performs annual compliance checks with all liquor license establishments and <br /> cigarette sellers. In 2018, all establishments passed their checks except the Southern Rail. It violated license <br /> requirements by serving an underage person. The presumptive penalty is a $500 civil fine and closing the bar <br /> for five days. <br /> The City has graduated penalties. A first offense in a 3-year period has a presumptive penalty of a$500 civil <br /> fine and closing the establishment for five days. These penalties are presumptive and the Council has the <br /> authority to waive all or part of these penalties. The bartender received a criminal charge and the license <br /> holders were notified of this violation.
