City of Centerville <br />Council Meeting Minutes <br />April 26, 2006 <br />City Administrator Larson indicated that the Planning Commission has <br />recommended approval of this site plan with a revision to the building to be <br />constructed of all masonry. He then said that the other condition was Staff <br />review. <br /> <br />Council Member Lakso asked whether they are going to have a garbage enclosure <br />outside. <br /> <br />Mr. Black indicated that will be kept in back behind the building. He then said <br />that it could be inside but he assumes they would want it outside and they can <br />show screening to meet the Code requirements. <br /> <br />Motion by Council Member Terway, seconded by Council Member Lakso to <br /> <br />approve the Site Plan for 2044 Gateway Circle based on the conditions of <br />Planning and Zoning, screening enclosure for the garbage and Staff review. <br />All in favor. Motion carried unanimously. <br /> <br /> 5. Encroachment Agreement for Bridge in Easement – 1937 Eagle Trail (Dolfay) <br /> <br /> City Administrator Larson indicated that this is the first of the bridges to come <br />before Council on the policy adopted concerning bridges in easements. He then <br />said that they have met the insurance requirements and the construction <br />requirements and Staff recommends approval. <br /> <br />Motion by Council Member Lee, seconded by Council Member Terway, to <br /> <br />approve the Encroachment Agreement for Bridge 1937 Eagle Trail. All in <br />favor. Motion carried unanimously. <br /> <br /> 6. Request to Construct Deck in Easement 7018 Eagle Trail (Boyd) <br /> <br />City Administrator Larson indicated that the resident has proposed to construct a <br />deck and in this situation there is an underlying easement from the utility <br />company of similar width that runs up to that easement line so it would not be <br />appropriate to vacate it. Staff recommends using the encroachment agreement <br />signing off that if it interferes with anything it will be removed at their expense. <br /> <br />Council explained to him that if necessary, the deck would need to be removed. <br />Mr. Boyd agreed. <br /> <br />Council Member Terway asked if it would be possible to vacate enough of the <br />easement to get all of his house, porch, and deck out of the easement. <br /> <br />City Administrator Larson indicated that it is a power company easement that the <br />City utilized so it would not be appropriate to do so. <br /> <br />Motion by Council Member Lee, seconded by Council Member Paar, to <br />approve an Encroachment Agreement for a deck at 7018 Eagle Trail.
