3. RIGHT TO PROCEED. Within the Final Plat or Land to be platted, the <br /> Developer may not grade (except as authorized in a Permit issued by the City) or otherwise <br /> disturb the earth, remove trees, construct sewer lines, water lines, streets, utilities, public or <br /> private improvements, or any buildings until all the following conditions have been satisfied: 1) <br /> this Agreement or subsequent amendments or codicils have been fully executed by all parties, <br /> including owners, lessors, lessees and mortgage holders, and filed with the City Administrator <br /> and recorded against the property, 2) the necessary security has been received by the City, 3) the <br /> Plat has been approved by the City Council and is in a form ready for recording with the Anoka <br /> County Recorder's Office, 4) the necessary easements, rights-of-ways, or covenants have been <br /> recorded against the property, and 5) the City Administrator has issued a letter that all conditions <br /> have been satisfied and that the Developer may proceed. The Final Plat will not be released to <br /> the Developer and may not be recorded until the necessary Security has been received and <br /> accepted by the City. The City Administrator shall issue the notice to proceed within seven (7) <br /> business days after receipt and acceptance of the security. <br /> 4. OTHER DEVELOPMENT. The City may refuse to approve future phases of <br /> development, certification of occupancy within this development, future planning or zoning <br /> applications,plats or development contracts by or with Developer if Developer has breached this <br /> Agreement, and the breach has not been remedied within the applicable notice period. <br /> 5. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of <br /> this Agreement, no amendments to the City's Comprehensive Plan or official controls shall apply <br /> to or affect the use, development density, lot size, lot layout or dedications of the approved Final <br /> Plat unless required by state or federal law or agreed to in writing by the City and the Developer. <br /> Thereafter, notwithstanding anything in this Agreement to the contrary, to the full extent <br /> VERSION FOR COUNCIL 05/22/2019 Page 4 <br />
