CITY OF CENTERVILLE <br /> REQUEST FOR <br /> COUNCIL ACTION Verville <br /> Agenda Item# Department: Requested Council Meeting Date: <br /> VIII.2.b Planning & Zoning/Legal 05/22/2019 <br /> TITLE OF ISSUE: <br /> Bay View Villas - Home Owners Association <br /> BACKGROUND AND SUPPLEMENTAL INFORMATION: <br /> The Development Agreement requires the creation of a Home Owners Association ("HOA"). The City's goal <br /> for requiring an HOA is to ensure the residents of a development perpetually maintain their common open <br /> spaces -not the City. Historically, when Developments or HOA fail, the City ends up owning outlots, <br /> marshlands, or monument signs. The HOA for Bayview allows the City to collect its operating costs and lost <br /> tax revenue from the residents in Bayview should the Bayview HOA fail to maintain their common lots or let <br /> them go into tax forfeiture. (Section 19 of the Agreement is the section that pertains to the City's rights. The <br /> remaining portions of that document do not pertain to City business.) <br /> This could be a new model for future developments in the City that use a HOA. <br /> COST AND SOURCE(S) OF FUNDING: <br /> No cost to the City.
