DECLARATION OF <br /> COVENANTS, CONDITIONS,AND RESTRICTIONS <br /> FOR <br /> BAYVIEW VILLAS <br /> THIS DECLARATION is made in the County of Anoka, State of Minnesota, on this <br /> day of May 2019, by Bayview Villas, LLC, a Minnesota limited liability company, (the <br /> "Declarant"), for the purposes of creating Bayview Villas, a planned community. <br /> WHEREAS, Declarant is the owner of that real property located in Anoka County, <br /> Minnesota, legally described on Exhibit A, attached hereto (the "Property"), and <br /> WHEREAS, Declarant desires to establish on the Property a plan for a permanent <br /> residential community to be owned, occupied and operated for the use, health, safety and welfare <br /> of its resident Owners and Occupants, and for the purpose of preserving the value, the structural <br /> quality, and the original architectural and aesthetic character of the Property, and <br /> WHEREAS, Bayview Villas is not subject to the Common Interest Ownership Act <br /> ("MCIOA"), Chapter 515B of the Minnesota Statutes. Bayview Villas is exempt from MCIOA <br /> pursuant to Minn. Stat. §515B.1-102(e)(2), because the Units consist solely of separate parcels of <br /> real estate designed or utilized for detached single family dwellings, and the Association has no <br /> obligation to maintain any building containing a dwelling or any agricultural building, and the <br /> Declarant has not elected to subject the Property to MCIOA. <br /> WHEREAS, the Property is not subject to an ordinance referred to in Section 51513.1- <br /> 106 of MCIOA, governing conversions of common interest ownership, and <br /> WHEREAS, the Property is not subject to a Master Association as defined in MCIOA. <br /> WHEREAS, the Property does include Shoreland, as that term is defined in Minn.
