(v) merge or consolidate a planned community with another planned community <br /> of the same form of ownership; (vi) appoint and remove the members of the <br /> Architectural Control Committee; (vii) appoint or remove any officer or director <br /> of the Association during the Declarant Control Period; and (viii) add additional <br /> real estate to this planned community. <br /> 1.27 "Unit" shall mean any platted lot subject to this Declaration upon which a <br /> Dwelling is located or intended to be located, as shown on the Plat, including all <br /> Improvements thereon, except Limited Common Elements, as defined herein, if <br /> any. <br /> SECTION 2 <br /> DESCRIPTION OF UNITS AND APPURTENANCES <br /> 2.1 Units. There are eighteen (18) single Units, all of which are restricted exclusively <br /> to residential use. Each Unit constitutes a separate parcel of real estate. No <br /> additional Units may be created by the subdivision or conversion of Units, except <br /> as allowed in Section 15, below. The Unit identifiers and locations of the Units <br /> are as shown on the Plat, which is incorporated herein by reference, and a list of <br /> the Units is set forth on Exhibit A. The Unit identifier for a Unit shall be its lot <br /> and block numbers and the subdivision name. <br /> a. Lots 1 — 9, Block 1, Bay View Villas, Anoka County, Minnesota are located <br /> along the shoreline of Centerville Lake, and shall sometimes be referred to <br /> herein as the"Lakeshore Units"; and <br /> b. Lots 1 — 9, Block 2, Bay View Villas, Anoka County, Minnesota are not <br /> located along the shoreline of Centerville Lake, and shall sometimes be <br /> referred to herein as the "Upland Units". <br /> 2.2 Unit Boundaries. The front, rear and side boundaries of each Unit shall be the <br /> boundary lines of the platted lot upon which the Dwelling is located or intended to <br /> be located as shown on the Plat. The Units shall have no upper or lower <br /> boundaries. However, a Unit may be subject to one or more easements running in <br /> favor of the Association, if set forth herein or otherwise properly recorded against <br /> the Unit. <br /> 2.3 Use and Enioyment Easements. Each Unit shall be the beneficiary of <br /> appurtenant easements for use and enjoyment on and across the Common <br /> Elements, and for use and enjoyment of any Limited Common Elements allocated <br /> to the Unit, subject to any restrictions authorized by this Declaration. <br /> 2.4 Utility and Maintenance Easements.
