CITY OF CENTERVILLE <br />COUNTY OF ANOKA <br />STATE OF MINNESOTA <br />RES. #19-0 /.3 <br />A RESOLUTION ADOPTING FINAL PLAT & DEVELOPMENT AGREEMENT <br />FOR <br />OLD MILL ESTATES <br />WHEREAS, ELMCREST VISTAS, a Minnesota Limited Liability Corporation, ("Applicant"), <br />is the fee owner of the Real Property legally described as: <br />The North Half of the North Half of the Northwest Quarter of the Southeast Quarter of <br />Section 14, Township 31, Range 22, Anoka County, Minnesota. <br />AND <br />The South Half of the North Half of the Northwest Quarter of the Southeast Quarter of <br />Section 14, Township 31, Range 22, Anoka County, Minnesota. <br />All parcels are subject to easements of record. <br />WHEREAS, Applicant obtained preliminary approval for the Plat, OLD MILL ESTATES. Said <br />preliminary Plat created a subdivision from the Real Property, dividing the Real Property into <br />blocks, lots, and outlots. Said preliminary Plat forms the basis of a phased development of the <br />entire Plat. <br />WHEREAS, the Planning and Zoning Commission, City Staff and Consultants RECOMMEND <br />the City Council APPROVE the Final Plat for OLD MILL ESTATES, subject to the following <br />conditions, and before said Final Plat can be filed and recorded with Anoka County: <br />A. The Final Plat is contingent upon execution of, and subject to the terms of a <br />Development Agreement with the City for the Platted land. <br />B. The Final Plat must meet the requirements and approval of the City Engineer. <br />C. The Final Plat must meet the requirements and approval of the County Surveyor. <br />D. The Final Plat must be recorded in a manner where it is not subordinate to any <br />easement, lien, mortgage, encumbrance, or other interest. <br />E. The Final Plat must be recorded simultaneously to the Applicant's grant of a Trail <br />Easement for Old Mill Estates, where the priority of the Easement is immediate to the <br />Plat. <br />F. The Final Plat and Easement must be recorded simultaneously to the Development <br />Agreement governing the Plat for Old Mill Estates where the priority of the <br />Agreement is immediate to the Plat and Easement. <br />Page 1 of 2 <br />
