WHEREAS, the Applicant and Staff negotiated a Development and Subdivision Agreement <br />governing the development of OLD MILL ESTATES, and recommends its adoption by the City <br />Council. A conforming copy is presented with this Resolution. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Centerville, <br />Minnesota, does Ordain, and <br />1. APPROVES the Final Plat for the OLD MILL ESTATES subject to the following <br />conditions: <br />a. Approval of the Final Plat is contingent upon execution of, and subject to the <br />terms of the Development and Subdivision Agreement governing OLD MILL <br />ESTATES, attached hereto. <br />b. Approval of the Final Plat is contingent on recording the Plat in a manner where it <br />is not subordinate to any easement, lien, mortgage, encumbrance, or other interest. <br />c. Approval of the Final Plat is contingent on its simultaneous recordation to the <br />Applicant's grant of a Trail Easement for OLD MILL ESTATES where the <br />priority of the Easement is immediate to the Plat. <br />d. Approval of the Final Plat is contingent on its simultaneous recordation to the <br />Development Agreement governing OLD MILL ESTATES where the priority of <br />the Agreement is immediate to the Plat and Trail Easement. <br />2. AUTHORIZATION FOR RECORDING the Final Plat with Anoka County is subject to <br />the following conditions: <br />a. The Final Plat must meet the requirements and approval of the City Engineer; <br />and, <br />b. The Final Plat must meet the requirements and approval of the County Surveyor. <br />3. The City Administrator shall determine when the conditions governing the Authorization <br />for Recording have been satisfied. Once the conditions have been satisfied he shall author <br />a letter certifying satisfaction of these conditions. <br />4.
