regulations applicable to the district in which it is to be located or otherwise <br />stated in this Chapter as a conditional use or interim use; <br />(b) Any use which is the same or similar, and consistent with, a conditional use <br />specified in the use district, the Planning Commission may consider and allow <br />such use as an interim use; and <br />(c) A use which is limited in scope or duration. <br />The Zoning Code, in 156.330(C), states the criteria for granting an Interim Use Permit. The <br />phrases in bold are intended to emphasize relevant information. It is worth noting how <br />the first three criteria for granting an Interim Use Permit are the same three criteria used <br />for granting a Conditional Use Permit. <br />(2) An Interim Use Permit shall be granted only if evidence is presented to establish: <br />(a) That the proposed building or use at the particular location requested is <br />necessary or desirable to provide a service or a facility which is in the interest of <br />the public convenience and will contribute to the general welfare of the <br />neighborhood or city; <br />(b) That the proposed building or use will not have a substantial or undue <br />adverse effect upon adjacent property, the character of the neighborhood, <br />traffic conditions, utility facilities and other matters affecting the public health, <br />safety and general welfare; <br />(c) That the proposed building or use will be designed, arranged and <br />operated so as to permit the development and use of neighboring property in <br />accordance with the applicable district regulations; and <br />(d) That the scope or duration of the proposed use is of a limited nature which <br />would not otherwise run with the land; <br />(e) That the scope or duration of the proposed use is subject to clearly <br />defined and stated limitations. <br />Conclusion <br />The Findings of Fact and conditions proposed by the Planning and Zoning Commission <br />meet these legal standards and are wise and appropriate grounds in support of their <br />recommendation to approve an Interim Use Permit. <br />C! <br />
