4. OTHER DEVELOPMENT. The City may refuse to approve future <br />development, certification of occupancy within this development, future planning or zoning <br />applications, plats or development contracts by or with Developer if Developer has breached the <br />Agreement or Supplement, and the breach has not been remedied within the applicable notice <br />period. <br /> 5. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of <br />mprehensive Plan or official controls shall <br />apply to or affect the use, development density, lot size, lot layout or dedications of the approved <br />Final Plat for Old Mill Estates Second Addition, unless required by state or federal law or agreed <br />to in writing by the City and the Developer. Thereafter, notwithstanding anything in the <br />Agreement or Supplement to the contrary, to the full extent permitted by state law the City may <br />require compliance with any amendments to the <br />platting or dedication requirements enacted after the date of this Supplement. <br /> 6. DEVELOPMENT PLANS. The Final Plat shall be developed in accordance <br />file with the City, and those Plans referenced <br />here. The Plans shall not be attached to the Agreement or Supplement. If the Plans vary from <br />the written terms of the Agreement, the written terms shall control. The approved Plans are as <br />follows: <br />A. Final Plat, Old Mill Estates Second Addition, prepared by EG Rud & Sons, Inc., <br />adopted by City Council 03/11/2020. <br />B. Grading, Drainage and Erosion Control Plans, prepared by Plowe Engineering, <br />C. Street and Utility Plans, prepared by <br />dated 10/17/2018 with revisions. <br />*These Street and Utility Plans now include additional draintile along the <br />south edge of Old Mill Estates Second Addition, Block 1, as directed by the <br />City Engineer. <br />Version 3/30/3030 - 1 Page 4 <br /> <br />
