<br />No. 2 irrigation areas. The final project layout may vary from the concept shown but will <br />provide an additional functional irrigation area of at least 7.8 acres beyond existing <br />conditions. <br />7. The City must submit to the District a copy of a signed agreement between the City and <br />the owner of each irrigated property not under City ownership. The agreement must <br />provide the City with the right to irrigate the indicated portion of the property, and to <br />inspect, operate and maintain the irrigation appurtenances located on the property, for <br />a period of at least 25 years from the effective date of this agreement. <br />8. The City will develop an operation, maintenance and monitoring (OMM) plan for the <br />Project a <br />withheld. The plan may be an update to an existing plan for the original stormwater <br />reuse irrigation system, but in any case, shall incorporate the original system and the <br />expansion as though they were one system. The final OMM plan will be designated as <br />an amendment to this Agreement and duly signed by the parties. The OMM plan will <br />include the following actions, at a minimum: <br />a. Operation of the stormwater reuse irrigation system for irrigation supply when <br />weather conditions and pond water elevations are suitable for irrigation <br />activities. <br />b. Inspection of the stormwater reuse irrigation system at least once annually. <br />c. Removal of accumulated sediment and debris and repair of erosion or structural <br />problems will be completed when reasonably necessary so that the facility <br />continues to operate as designed. <br />d. Performance of routine maintenance activities on the stormwater reuse <br />irrigation system. <br />e. Continuous collection of flow meter data for the stormwater reuse irrigation <br />system while the system is operational. A summary of the data will be submitted <br />to the District annually. <br />9. The City will own the Project and operate and maintain the Project, in perpetuity, in <br />accordance with the approved OMM plan. <br /> <br />Section C: Financial Obligations <br />10. <br />certification that construction has been completed, the City's operational <br />demonstration of the Project to the District, and the District's receipt of easements and <br />the signed OMM plan. The City is responsible for all other Project-related design and <br />construction costs, including any cost overruns. <br />11. The City is responsible for the cost of all post-construction operation, maintenance and <br />monitoring of the Project. <br /> <br />
