periodic change when dictated by the City. Minimum conditions for security require <br />surveillance of all exterior areas and points of egress on the Property. Surveillance shall <br />be conducted at all times of day and night; shall be subject to remote monitoring; and, <br />shall be recorded and stored for a minimum of 180-days. Security and surveillance <br />materials and recordings shall be made available at the request of law enforcement <br />authorities without a search warrant, and such requests must be fulfilled within 5-days. <br />i. The Property shall have daily business hours of operation limited from 7:00 a.m. to 9:30 <br />p.m. Except during these business hours, no person other than the Landowner, or an <br />owner or employee of the business operator of the mini storage facility is allowed on the <br />Property. <br />j. The Property may only be used by a single business entity as a principal place of <br />business, and that business entity is further limited to using the Property exclusively to <br />operate a mini storage facility. The operator of the mini storage facility may rent to <br />tenants or lessees with the following permissions and conditions: 1) tenants or lessees <br />may conduct their business activity on the Property on the condition that they do not use <br />the Property as a principal place of business; and, 2) tenants or lessees may not allow <br />vehicles to park or stand on roadways within a half-mile of the Property. <br />k. The operator of the mini storage facility may sell or auction unclaimed or abandoned <br />property recovered from storage units on the Property. On-site sales or auctions of these <br />items may be conducted on the Property. On-site sales are limited to no more than four <br />per calendar year and may only offer property recovered from storage units on the <br />Property. Other than employees or contractors of the business operator of the mini <br />storage, no more than twenty people may be allowed to enter the Property to attend an <br />on-site sale. <br />l. Nothing may be stored on the Property unless lawfully stored inside a structure. <br />m. Operations on the Property may not produce noise, vibrations, air pollution, light <br />pollution, fire hazards, or noxious emissions, except for those specifically authorized <br />under City ordinance, or other law or regulation, and in no event shall operations on the <br />Property interfere with the safety or enjoyment of neighboring properties. <br />n. The Landowner and all operations on the Property must abide by applicable laws and <br />regulations including but not limited to the standards and requirements of the Rice Creek <br />Watershed District, Army Corp of Engineers, Federal Emergency Management Agency, <br />Minnesota Department of Natural Resources, and more generally, the City of Centerville, <br />Anoka County, State of Minnesota, and United States of America. <br />o. Landowner and business operator of the mini storage facility shall be responsible for the <br />continuing conformance with the Permit and that if the proposed use is not initiated <br />within six (6) months of this date, the Permit shall be void. <br />p. The City reserves the right to, annually, or as often as issues present themselves, review <br />this permit for compliance with the conditions and may impose additional conditions to <br />mitigate unforeseen problems. <br />q. The conditions, language, and terms of art set forth in this Permit shall be interpreted in <br />the same manner as they are set forth in the Centerville Code of Ordinances. <br /> <br />4. Penalties: <br /> a. Violation of any single condition of this Permit renders the Permit void at the time of the <br />violation and thereafter subject to revocation by the City. <br /> b. Notwithstanding any other means for enforcement of this Permit, violation of the terms <br />of this permit is a criminal misdemeanor. <br />Ћ <br /> <br /> <br />
