<br /> <br /> <br /> A DEVELOPMENT & SUBDIVISION AGREEMENT effective May 22, 2019, and a <br />FIRST SUPPLEMENTAL AGREEMENT effective May 27, 20202, (collectively referred to as <br />CITY OF CENTERVILLE, a Minnesota municipal <br />ELMCREST VISTAS, a Minnesota Limited Liability Corporation, (the <br />SECOND SUPPLEMENTAL AGREEMENT AND CODICIL <br /> is effective August 12, 2020, as a supplement and codicil to the original <br />Agreement. <br /> The Agreement is controlling and governs the terms and conditions between the parties <br />except where specifically set forth in this Supplement. The Plat for Old Mill Estates was the first <br />phase of development as contemplated by the Agreement, and the Plat for Old Mill Estates Second <br />Addition is the second phase of development as contemplated by the Agreement. This Supplement <br />is intended to amend and revise aspects of the Agreement which relate to the development of Old <br />Mill Estates Second Addition. If the terms and conditions contained in the Agreement and <br />Supplement are in conflict, the contents of the Supplement shall take precedence over the contents <br />of the Agreement. <br /> 1. REQUEST FOR PLAT AND DEVELOPMENT APPROVAL. The Developer <br />has asked the City to approve a final plat for Old Mill Estates Second Addition. Hereinafter, this <br />plat revision shall be referred to as a request for final plat approval for Old Mill Estates Second <br />Addition (referred to in this S <br /> situated in the County of Anoka, State of <br />Minnesota, and is legally described on the attached Exhibit A, including easements described <br />therein.
