2. CONDITIONS OF PLAT AND DEVELOPMENT APPROVAL. <br /> At such time as the City approves the Final Plat and the Development Plans for <br />development of the Second Addition, and the Developer receives the Right to Proceed as set forth <br />below, the Developer may record the Plat with the County Recorder or Registrar of Titles within <br />one hundred (100) days after approval of the Plat. If the Plat and any associated easements or <br />covenants are not recorded within the one hundred (100) days, the approval of the Plat is void, <br />unless a written request for an extension is submitted to the City Administrator before the one <br />hundred (100) days expire. The extension will be approved or denied by the City Council by <br />placement on their agenda within fifteen (15) days of request for same. Such Plat shall contain all <br />easements required for the construction and maintenance of improvements for the development. <br /> 3. RIGHT TO PROCEED. Within the Final Plat or Land to be platted, the <br />Developer may not grade or construct sewer lines, water lines, streets, utilities, public or private <br />improvements, or any buildings until all the following conditions have been satisfied: 1) the <br />Agreement, this Supplement, or subsequent amendments or codicils have been fully executed by <br />all parties, including owners, lessors, lessees and mortgage holders, and filed with the City <br />Administrator and recorded against the property, 2) the necessary security has been received by <br />the City, 3) the Final Plat has been approved by the City Council and is in a form ready for <br />recording with the Anoka County ssary easements, rights-of-ways, <br />or covenants have been recorded against the property, and 5) the City Administrator has issued a <br />letter that all conditions have been satisfied and that the Developer may proceed. The Final Plat <br />will not be released to the Developer and may not be recorded until the necessary Security has <br />been received and accepted by the City.
