City of Centerville <br />Council Meeting Minutes <br />August 12, 2020 <br /> <br />nd <br />1. Developer’s Agreement – Old Mill Estates 2 Addition <br /> <br />Administrator Statz reminded Council that right before COVID-19, the developer submitted for <br />Final Plat of Phase II for Old Mill Estates. He stated then the developer chose to pull the <br />Developer’s Agreement from consideration due to housing uncertainties and the economic effects <br />that COVID-19 may have. Administrator Statz stated that now the developer is requesting <br />consideration of the Developer’s Agreement for the project. He reminded Council that the Final <br />Plat was contingent upon the agreement. <br /> <br />City Attorney Glaser stated that all are ready for approval. He stated that the Developer’s <br />Agreement follows the original agreement, holds escrows, sets standards for public improvements, <br />etc. He stated that the agreement is a supplement agreement to the master agreement previously <br />adopted. <br /> <br />Council Member Koski asked if the fees associated with the development were budgeted. <br />Administrator Statz stated that certain fees were and others were not as the fees are accounted for <br />similarly to Capital Funds (park dedication fees, storm water fees, etc.). Council Member Koski <br />asked if the $10,000 cash escrow was customary. City Attorney Glaser concurred and stated if the <br />balance were to fall below this level, Staff would request replenishment. <br /> <br />Mayor Love asked whether the addition being delayed affected the budget for permits. <br />Administrator Statz stated that estimates were conservative and he was unsure if permits would be <br />able to be pulled this fall. He stated that he felt that the line item was on track and about where <br />predicted. <br /> <br />Motion by Council Member Wilharber, seconded by Council Member Montain to Approve <br />nd <br />the Final Plat & Developer’s Agreement – Old Mill Estates 2 Addition as Presented. A <br />roll-call vote was taken. Mayor Love and Council Members Lakso, Koski, Montain & <br />Wilharber voted in favor. Motion carried. <br /> <br />2. Ordinance #XX, Second Series – Amending to Ordinance #105, Second <br />Series – Driveway Location and Width (First Reading) <br /> <br />Administrator Statz stated that shortly following the adoption of Ordinance #105, Second Series <br />staff encountered an error in the language. He stated that correction needed to be made that a <br />driveway can be in a setback but cannot be less than 5’ from the lot line. He stated that if there <br />was a drainage/utility easement larger than 5’ an encroachment would need to be obtained to install <br />the driveway. <br /> <br />Mayor Love asked if anyone was in this situation and Administrator Statz stated that they would <br />be grandfathered in. Administrator Statz stated that the previous regulations were 5’ from the <br />property line and if there was a larger drainage/utility easement an encroachment agreement was <br />needed. He stated that it was never the intent to modify this language. <br /> <br />Mayor Love stated that this was the first reading of the Code so no motion was needed. <br /> <br />IX.
