April 6, 2021 <br />Centerville Planning & Zoning Commission <br />Page 5 of 10 <br />RE: Belleville Landing Apartments – Land Use Plan Amendment, Rezoning, PUD/CUP, Site Plan Review <br />Planned Unit Development/Conditional Use Permit <br />A Planned Unit Development (PUD) is processed as a CUP in the Centerville Zoning Code. The <br />criteria for considering a PUD are included on the following page. Flexibility on zoning standards <br />can be given in exchange for other benefits. <br />The Belleville Landing plan is laid out simply – one building of 103 units in three floors above a <br />st <br />Avenue. If the Land Use Plan is <br />parking below,a surface parking lot, with site access off 21 <br />amended as requested above, the development would be consistent with the comprehensive <br />plan, it would be compatible with surrounding land uses, it does not pose a risk to natural <br />amenities, and it would not be a burden on parks, schools, streets or other public facilities. <br />A CUP must meet the criteria in Section 156.320 of the Zoning Code – basically that the use is <br />necessary and desirable; that it will not adversely impact the neighborhood; and that it is <br />designed to allow development of neighboring property. <br />The one area of flexibility that is requested in the PUD is the height of the building – it is 48.5 ft in <br />height vs. the 35 ft height limit in the Code, or 13.5 ft more. Section 156.121 Height addresses this: <br />(B)Excess height on a building. Upon the securing of a conditional use permit any building may be <br />erected to a height exceeding that specified for the respective district, provided the front, rear and <br />side yards shall be increased one foot for each one foot by which the building exceeds the height <br />limit established for that district. <br />The building will be three stories of apartments above one level of parking. This is typical of <br />apartment development and not unreasonable.
