Placing the garage at the required setback would remove some of those trees. <br /> <br />4) The proposed garage is to be placed approximately 31 feet from the front lot line <br />compared to the required 35-foot setback, a variance of approximately 4 feet. <br /> <br />5) There is a row of existing trees on the north lot line that will screen the proposed garage, <br />softening the impact of the encroachment into the setback. <br /> <br />6) Several existing homes and garages along Mound Trail are at 35- to 40-foot setbacks. The <br />character of Mound Trail is one with many structures close to the street. <br /> <br />7) The request meets the criteria for granting a variance in the Centerville Code. <br /> <br />If the Planning & Zoning Commission decides to recommend denial of the variance, possible <br />findings of fact for denial could include the following: <br /> <br />Findings of Fact for Denial <br /> <br />1) The proposed garage could meet the required 35-ft setback by moving it south a few feet, <br />potentially removing some of the existing trees in that area. This tradeoff is preferable to <br />encroaching in the setback. <br /> <br />2) There are other options to building a new garage that would not require a variance, <br />including in the area where the existing garage is, without removing any trees. <br /> <br />3) There is an existing garage on the property, which is already a reasonable use of the <br />property. A new garage is not a necessity. <br /> <br />4) Building the garage within the required setback would alter the essential character of the <br />locality by being closer to Mound Trail than an of the other homes or garages along this <br />street. <br /> <br />5) There are not unique circumstances on the property that pose challenges to meeting the <br />required setback. <br /> <br />6) The request does not meet the criteria for granting a variance in the Centerville Code. <br /> <br />DEADLINE FOR FINAL ACTION <br />The variance application was received on June 10, 2021.
