July 13, 2021 <br />Centerville Planning & Zoning Commission <br />Page 5 of 6 <br />Variance criteria in Sect. 156.310(A): <br />1) The variance is in harmony with the purposes and intent of the zoning chapter of this code; <br /> <br />2) The variance is consistent with the comprehensive plan; and <br /> <br />3) The proposal puts the property to use in a reasonable manner; and <br /> <br />4) There are unique circumstances to the property not created by the landowner; and <br /> <br />5) The variance, if granted, will not alter the essential character of the locality; <br /> <br />OPTIONS <br />The Planning & Zoning Commission could: <br /> <br />1) Recommend approval of the variance as submitted, with conditions and findings of fact. <br /> <br />Motion: I move that the Planning & Zoning Commission recommend approval of the <br />variance \[as submitted or modified\], \[with conditions\], \[with findings of fact for approval\]. <br /> <br />2) Recommend denial of the variance, with findings of fact. <br /> <br />Motion: I move that the Planning & Zoning Commission recommend denial of the <br />variance, \[with findings of fact for denial\]. <br /> <br />3) Continue the item for more information or further discussion. <br /> <br />Motion: I move that the Planning & Zoning Commission continue the item to \[date\] in order <br />to gather more information. <br /> <br />RECOMMENDATION <br />I recommend approval of the variance to the front yard setback at 1313 Mound Trail as <br />submitted, with the condition that the existing trees along Mound Trail and to the west toward the <br />neighboring property be maintained or replaced with similar landscaping to be reviewed and <br />approved by the City Engineer. <br /> <br />Findings of Fact for Approval <br /> <br />1) The proposed use of the property for a garage on a single family lot is reasonable. <br /> <br />2) Placing the garage on the lake side of the lot would not be reasonable or in keeping with <br />the character or wishes of the residents of the lakeshore environment. <br />79 <br /> <br />
