City of Centerville <br />Council Meeting Minutes <br />April 28, 2021 <br />Administrator Statz clarified that if the Council passed this it would allow a car wash as an <br />accessory to retail fuel sales (gas station) only as a conditional use. He gave a quick overview of <br />how CUPs work and noted that it means that the City can put conditions on the use and does not <br />mean that the use can be denied. He explained that the conditions need to be reasonable and be <br />things like limiting noise, hours of operation and not things like standing on your head and clapping <br />three times. <br /> <br />Council Member King reiterated his question that if the Council passes this, the CUP for Kwik <br />Trip will not be necessary and noted that the agenda item tonight was Plan Review for the Kwik <br />Trip. <br /> <br />Administrator Statz explained that the CUP is not on the CouncilÓs agenda tonight because that <br />would look to be done after the ordinance is adopted. He stated that tonightÓs item is just a first <br />reading and noted that the second reading would be on May 12, 2021, so the CUP would be <br />presented on that agenda. <br />Council Member King confirmed with Administrator Statz that his understanding is that if this <br />ordinance is passed, it would give Kwik Trip permission to have a car wash, just with conditions. <br />He stated that he has received a lot of phone calls and e-mails about this issue. He stated that he <br />would like this item to be tabled because there is so much information to get through. He noted <br />that he would like the newspaper to print up a story so there could be more input from the citizens, <br />even those outside of the notice area. He reiterated that he believes this should be tabled and the <br />City should have a bigger public forum on this issue. <br />Mayor Love stated that he thinks it is important that there are conversations and reference these <br />items tonight. He stated that there is a landowner who is trying to sell his land and he has a right <br />to have the Council discuss his proposal and have it done swiftly. He stated that he believes the <br />City is approaching the 60-day limit and due to the delay of the Planning and Zoning Commission <br />meeting, he believes there is going to need to be an extension, but noted that he does not think that <br />should just be done arbitrarily. <br /> <br />Administrator Statz explained that Minnesota State law requires that the City act on Zoning <br />proposals within 60 days or they are deemed to be accepted. The City is allowed to give <br />themselves one 60-day extension. He noted that he believes the initial 60-day period expires next <br />week and regardless of what action is taken tonight, there will need to be an extension. He <br />explained that this means the City has two more months to act, otherwise this would just be <br />accepted. <br /> <br />Council Member Lakso stated that she is not in favor of changing the ordinance at this time and <br />would echo some of the thing brought up by Council Member King. She stated that she is fine <br />with discussion but does not want to make any decisions without tabling this and getting more <br />input. She stated that she does not believe she has personally had enough time to process all of <br />the comments that were made on Monday as well as the deluge of e-mails she has received. <br /> <br />Mayor Love noted that this is a first reading of the ordinance so the vote will not be called tonight. <br /> <br />Council Member Koski stated that he is in favor of the overall spirit of what this ordinance is <br />Page 6 of 26 <br /> <br />
