withinten(10)daysafterreceiptbyContractorofwrittennoticefromCountysettingforththenatureofsaidbreachor <br />default,CountyshallhavetherighttoterminatetheContractwithoutanyfurtherobligationtoContractor.Anysuch <br />terminationfordefaultshallnotinanywayoperatetoprecludeAgency <br />fromalsopursuingallavailableremediesagainst <br />Contractoranditssuretiesforsaidbreachordefault. <br />P. CONTRACTWORKHOURSANDSAFETYSTANDARDSACT <br />ContractWorkHoursandSafetyStandardsAct.TheAgencyHeadshallcauseorrequirethecontractingofficertoinsert <br />thefollowingclausessetforthinparagraphs(1),(2),(3),and(4)ofthissectioninfullinanycontractinanamountin <br />excessof$100,000andsubjecttotheovertimeprovisionsoftheContractWorkHoursandSafetyStandardsAct.These <br />clausesshallbeinsertedinadditiontotheclausesrequiredby§5.5(a)or§4.6ofpart4ofthistitle.Asusedinthis <br />paragraph,theterms laborers and mechanics includewatchmenandguards. <br />(1) Overtimerequirements.Nocontractororsubcontractorcontractingforanypartofthecontractworkwhich <br />mayrequireorinvolvetheemploymentoflaborersormechanicsshallrequireorpermitanysuchlaboreror <br />mechanicinanyworkweekinwhichheorsheisemployedonsuchworktoworkinexcessoffortyhoursin <br />suchworkweekunlesssuchlaborerormechanicreceivescompensationataratenotlessthanoneandone <br />halftimesthebasicrateofpayforallhoursworkedinexcessoffortyhoursinsuchworkweek. <br />(2) Violation;liabilityforunpaidwages;liquidateddamages.Intheeventofanyviolationoftheclausesetforth <br />inparagraph(b)(1)ofthissectionthecontractorandanysubcontractorresponsiblethereforshallbeliablefor <br />theunpaidwages.Inaddition,suchcontractorandsubcontractorshallbeliabletotheUnitedStates(inthe <br />caseofworkdoneundercontractfortheDistrictofColumbiaoraterritory,tosuchDistrictortosuch <br />territory),forliquidateddamages.Suchliquidateddamagesshallbecomputedwithrespecttoeachindividual <br />laborerormechanic,includingwatchmenandguards,employedinviolationoftheclausesetforthin <br />paragraph(1)ofthissection,inthesumof$27foreachcalendardayonwhichsuchindividualwasrequired <br />orpermittedtoworkinexcessofthestandardworkweekoffortyhourswithoutpaymentoftheovertime <br />wagesrequiredbytheclausesetforthinparagraph(1)ofthissection. <br />(3) Withholdingforunpaidwagesandliquidateddamages.The(writeinthenameoftheFederalagencyorthe <br />loanorgrantrecipient)shalluponitsownactionoruponwrittenrequestofanauthorizedrepresentativeof <br />theDepartmentofLaborwithholdorcausetobewithheld,fromanymoneyspayableonaccountofwork <br />performedbythecontractororsubcontractorunderanysuchcontractoranyotherFederalcontractwiththe <br />sameprimecontractor,oranyotherfederallyassistedcontractsubjecttotheContractWorkHoursand <br />SafetyStandardsAct,whichisheldbythesameprimecontractor,suchsumsasmaybedeterminedtobe <br />necessarytosatisfyanyliabilitiesofsuchcontractororsubcontractorforunpaidwagesandliquidated <br />damagesasprovidedintheclausesetforthinparagraph(2)ofthissection. <br />(4) Subcontracts.Thecontractororsubcontractorshallinsertinanysubcontractstheclausessetforthin <br />paragraph(1)through(4)ofthissectionandalsoaclauserequiringthesubcontractorstoincludethese <br />clausesinanylowertiersubcontracts.Theprimecontractorshallberesponsibleforcompliancebyany <br />subcontractororlower <br />tiersubcontractorwiththeclausessetforthinparagraphs(1)through(4)ofthis <br />section. <br />12 <br /> <br />
