Therearesubstantialgradedifferencesbetweenthelotsandalongtheswaleresultingin <br />poolingofwaterandpersistentstandingwater,aswellasalargeareaoflandthatneverdries <br />despiteoneofthedriestsummersonrecord.Thecityrequiredasbuiltsurveysforsomeofthe <br />lots(althoughnotothers);however,thosesurveyswerecompletedpriortotheinstallationof <br />thetopsoilandsod,andthereforetheconditionstodaydemonstrateasignificantvariancefrom <br />theplan. <br />2. Thedraintilepipe,thoughrecentlyverifiedtocarrywater,isburieddeepbelowcompactedclay <br />soilandisthereforeprovencompletelyinsufficient,asconstructed,toconductthewater <br />managementplanforthedevelopment.Cameraworktoverifytheconditionofthepipehas <br />beendelayedformonthsduetoadisputebetweenthedeveloperandthedraintileinstaller. <br />3. Theseconditionshavebeeninplacesincethefirstresidentsmovedinmorethanayearagoand <br />therehasbeenlittletonoactiontoremedythesituationtakenbythedeveloper,despitethe <br />persistentrequestsofcitystaffattheurgingoftheresidents.Thereisatthispointnotimeline <br />fortheidentificationandremediationoftheseissuesdeliveredbythedevelopertothe <br />th <br />homeowners,despitetherecentbreechoftheSeptember7,2021finaldeadlinetocomplete <br />theoutstandingitems,whichthemselveswerealreadysubstantiallyoverdue.Whilesome <br />progresshasbeenmadeonafewitemshereandthere,itisclearthatthemerethreatofcity <br />actionsinthefaceofnoncomplianceisinsufficientmotivationtoaddresstheseissues. <br />Requests:Werequestthecitycouncildirectstafftotakeactioninthefollowingways: <br />ItemsagreedtoonSeptember30,2021: <br />1. Surveyofconditionofthedrainageswalerunningalongalllotsonthenorthofoldmillestates <br />andidentifyanycurrentlyexistingdiscrepanciesfromthegradeasplanned. <br />2. Testtheentiredraintileforcorrectpositionintheswale,aswellasanybowinginthelineitself. <br />Assessthedepthofthepipebelowthesoilandcompareittotheplantodetermineiffurther <br />correctionisrequired. <br /> <br />
