Takeactionstokeepthehomeownersinformedoftheprogressoftheseissuesandother <br />remainingpunchlistitemsatOldMillEstates.Thereisessentiallyzerocommunicationfromthe <br />developertothemorethan20residentswhonowliveinastilluncompleteddevelopmentwith <br />patchworksidewalks,mailboxesthatexistonsawmilltrusses,andwhatisineffect,awetland <br />acrossasoddedbackyard. <br />Timeline/Background: <br />August2020:Firstresidentsmoveinto1833OldMillcourt.Thewaterissueswereobviousimmediately <br />andcontactwasmadewiththecityandthebuilder.Noactionwastakenatthattime. <br />March2021:Withthesnowmeltthehomeownersof1833and1821noticedthattherewasaserious <br />drainageissueacrossthetwolots,theonlytwotohavebeencompletedatthattime.Therewasnearly <br />6inchesofwaterintheswaleanditwasapparentthatallofthedrainagewassurfacerunoff,despite <br />theoriginalplanbeingthatthemajorityofthewatermanagementwouldbeaccomplishedbythe <br />draintile,therebypermittinga1%gradeinsteadofa3%gradewhichwouldhavebeenmorecommon. <br />May2021:Thehomeownersbringthecontinuedwaterissuestotheattentionofcitystaffatanin <br />personmeeting.TheyreferthehomeownerstoBrandonJohnsonatStantecwhoreceivestheevidence <br />ofissueandcommitstoworkontheissuewiththedeveloper.Theyexpresstheintenttotestthedrain <br />tilesystemwithWeidemaConstructionatsomepointinthesummer. <br />JuneJuly2021:Afterahomeowneremailtothedeveloperccingallaffectedparties,ToddChristensen <br />sendswhatistodatehisonlycommunicationtotheresidentsonthewaterissuesonthenorthsideof <br />hisdevelopment.Inhisemailhestatesthatthegradeiscorrectbutacknowledgesthatthedraintile <br />maybepluggedordamaged.Brandonremainsincontactwiththehomeownersastestingthedraintile <br />isscheduledandrescheduledmultipletimes.InanemailinJune2021,Brandonalsoindicatesthathe <br />hasnoticedthegradeissuesasreportedbythehomeowners.Hesaystheseitemshavebeenaddedto <br />theĭźƷǤƭpunchlist.AlthoughBrandonhasbeenresponsiveandisclearlyattemptingtocorrectthese <br />issues,heacknowledgesinaJulyemailthattheonlytoolsathisdisposaltoforcecomplianceareto <br />retaindeveloperfundsuntiltheissuesarecompleteandtoremindhimofhiscommitments. <br />st <br />July26,2021:ThecityğķƒźƓźƭƷƩğƷƚƩƭreportstatesthatafinaldeadlineofSeptember1hasbeenset <br />forfinalcompletionofthedeveloperspunchlistandstatingthatanyremainingworkwillbeundertaken <br />bythecityusingtheķĻǝĻƌƚƦĻƩƭletterofcredit.Thehomeownersseekclarificationthatthisdeadline <br />alsoincludesfixingtheitemsalreadyinstalledwhicharenonfunctionallikethedrainageissues.Thisis <br />verifiedbycitystafftobetheplan. <br />August2021:Anextensionofthedraintilepipewasplacedonthefarwestendextendingintothe <br />wetland,however,therehasstillnotyetbeenafullscopeofthedraintilesystem,norhasanyone <br />undertakenasystematicexaminationofthegradeissuesasacknowledgedbytheĭźƷǤƭrepresentative <br />inJuly,anddeniedbythedeveloper. <br /> <br />
