November 2, 2021 <br />Centerville Planning & Zoning Commission <br />Page 8 of 10 <br />RE: Shingle Creek Capital, LLC - Rezoning and Conditional Use Permit <br />Conditional Use Permit <br />If the rezoning is approved, then a CUP could follow to allow the outside storage along with <br />reasonable conditions related to other site features. There are details missing that would the City <br />to develop full conditions, plus Site Plan review will be required by the Planning & Zoning <br />Commission at some point. It may be appropriate for the Planning & Zoning Commission to <br />consider an informal review of the CUP, giving the applicants direction on their wishes, but holding <br />off on a final recommendation until such plans have been submitted. <br />RECOMMENDATION <br />Rezoning B-2 to B-1 <br />We recommend approval of the rezoning of 2050 and 2070 Main Street from B-2 to B-1 provided <br />the applicant also secures a conditional use permit for the proposed use. <br />Findings of Fact - Approval of Rezoning <br />1) The property at 2050 and 2070 Main Street is zoned B-2 Main Street Commercial. <br />2) The current use of the property is industrial in nature. <br />3) The depth of the lots, subsurface environmental conditions on the property, and right- <br />in/right-out access to Main Street make it difficult to develop the property with small retail <br />uses as envisioned for the B-2 Main Street Commercial district. <br />4) The proposed use will be an improvement over the existing state of the property and a <br />significant investment but not all the way to the Main Street retail vision the City has. <br />5) The proposed rezone to B-1 will allow a transition of the existing industrial use of the <br />property and structure to a commercial site as envisioned for the B-2 Main Street <br />Commercial district. After the new, transitional use is established, the property will be <br />rezoned back to B-2 to ensure the eventual transition of the property to a commercial use, <br />and promote uniformity among the neighboring properties. <br />
