November 2, 2021 <br />Centerville Planning & Zoning Commission <br />Page 9 of 10 <br />RE: Shingle Creek Capital, LLC - Rezoning and Conditional Use Permit <br />Should the Planning & Zoning Commission want to recommend denial of the rezoning, the <br />following findings of fact might be considered: <br />Findings of Fact - Denial of Rezoning <br />1) The property at 2050 and 2070 Main Street is zoned B-2 Main Street Commercial. <br />2) The current use of the property is industrial in nature. <br />3) The intent of the City in the B-2 Main Street Commercial zoning district is to provide <br />community scale retail commercial uses, not highway oriented uses or uses that require <br />warehousing and outside storage. <br />4) The requested rezoning would allow for uses, including outside storage, that are <br />inconsistent with the City's vision and desire for this portion of Main Street. <br />Conditional Use Permit <br />If there is a recommendation for a rezoning to B-1, we recommend approval of the conditional <br />use permit with the following conditions, contingent on a more detailed review and approval <br />once more detailed materials are submitted as stipulated below: <br />1) Complete a site plan review process for outside storage. <br />2) The entire property, including the building and storage and staging area, shall only be <br />used for building supply sales as described in the application, depicted on the submitted <br />plans and covered by this conditional use permit. <br />3) All goods, materials, and supplies must be stored with the building or within the screened <br />storage and staging area. The storage area must be completely screened from adjoining <br />properties and rights -of -way. <br />4) All outdoor storage and staging areas must be maintained and kept in an orderly <br />condition. <br />5) All parking shall be managed on site and all customer parking shall be located within the <br />customer parking area located adjacent to the existing building. <br />6) At least one van accessible parking space per ADA standards shall be provided in the <br />customer parking area at the front of the site. <br />7) The fence enclosing the storage and staging shall be no more than 8 feet in height and <br />constructed of durable materials to be submitted for review by the Planning & Zoning <br />Commission and City Council. <br />
