CITY OF CENTERVILLE <br />ANOKA COUNTY, MINNESOTA <br />SUMMARY OF ORDINANCE #121, SECOND SERIES Î AMENDED LANGUAGE TO <br />CITY CODE, CHAPTER 153, SUBDIVISION REGULATIONS, §153.15, GENERAL <br />PROVISIONS, (B) LAND DEDICATION <br /> <br /> NOTICE IS HEREBY GIVEN that, on December 7, 2021, the Planning & Zoning <br />Commission held a public hearing regarding Ordinance #121, Second Series Î Amending Language <br />to City Code, Chapter 153, Subdivision Regulation, §153.15, General Provisions, (B) Land <br />Dedication. <br /> <br /> NOTICE IS FURTHER GIVEN that, the City Council of the City of Centerville completed <br />two (2) readings of this item (January 12, & January 26, 2022). The City Council has directed that a <br />title and summary be prepared for publication pursuant to Minn. Stat. 412.191, Subd 4. <br /> <br /> NOTICE IS FURTHER GIVEN that a complete, printed copy of Ordinance #121, Second <br />Series Î Amending Language to City Code, Chapter 153, Subdivision Regulations, §153.15, General <br />Provisions, (B) Land Dedication and the entire Chapter 153 is available for inspection by any person <br />during regular office hours at the office of the City Clerk, 1880 Main Street, Centerville, MN, or will <br />be mailed to anyone requesting it by telephone (651) 429-3232. <br /> <br /> NOTICE IS FURTHER GIVEN that the City of Centerville hereby ordains (To Be <br />Removed Language = Strike Through and New Language = Underlined) and the above stated <br />section will read as follows: <br /> <br />Section 1. <br /> <br />153.15 GENERAL PROVISIONS <br /> <br />(B) Land dedication. In all new subdivisions, ten percent of the gross area subdivided shall <br />be dedicated for public recreation space, with this ten percent being in addition to <br />property dedicated for streets, alleys, easements or other public ways. No areas may be <br />dedicated for public use until the areas have been approved as being suitable and needed <br />for the public health, safety, convenience and/or general welfare. When the subdivision is <br />too small for practical dedication of public land or if no land in the subdivision is suitable <br />for that use If the city decides that no land dedication is needed, or less than 10% of the <br />land is needed for dedication, the subdivider shall be required to pay a Park Dedication <br />fee as per the schedule in effect at the time of Preliminary Plat approval in lieu of such <br />dedication. The payment of the fee shall be due in conjunction with the recording of the <br />plat. By agreement, the city may allow the subdivider to delay payment of Park <br />Dedication Fees to the time of the building permit issuance on each lot. However, the <br />agreement must hold the subdivider ultimately responsible for the payment of those fees <br />if not paid by the builder. An escrow or other security may be required to secure those <br />funds.per lot created or ten percent of the subdivision land value, whichever is greater, <br />prior to subdivision; the value (market) of the land shall be determined by negotiation <br /> <br />
