City of Centerville <br />Council Meeting Minutes & Closed Exec. <br />August 11, 2021 <br /> <br /> <br />VII. CONSENT AGENDA <br /> <br />1. City of Centerville Claims through August 11, 2021 (Check #33945-33950 & <br />Check #34451-34469) & (1743-1747E) <br />2. Centennial Lakes Police Department Claims through August 5, 2021 (Check <br />#13939-13960) & (2021039E) <br />3. Centennial Fire District Claims through August 10, 2021 (Check 9136-9140) <br /> <br />Mayor Love provided an opportunity for the Council to add or remove any item(s) to/from the <br />consent agenda. <br /> <br />Motion by Council Member King, seconded by Council Member Koski, to Approve Consent <br />Agenda as Presented. All in favor. Motion carried. <br /> <br />VIII. OLD BUSINESS <br /> <br />1. Block 7 – Centra Homes <br />a. Purchase Agreement <br /> <br />Administrator Statz stated that lengthy discussion has been had regarding this agreement both at <br />City Council level, with staff and with Centra Homes representatives. He stated that the presented <br />Purchase Agreement addresses each of the three (3) concerns that Council discussed: project <br />delays capped at 24 months (“Force Majeure” clause); property returned to the City if failure to <br />complete improvements within 24 months (“Reverter” clause); and developer escrowed funds <br />assuring funding of the Homeowners Association (HOA) due to failure of the project prior to <br />completion and sale of units (“HOA Pre-Funding” clause). <br /> <br />Lengthy discussion ensued regarding, Community Development Block Grant (CDBG) Funding, <br />Letter of Credit (LOC) requirements, market rate/affordable units (two), attempting to save mature <br />trees on the site, length of term for funding the HOA and associated dollar amount, streetscaping <br />of $100,000 with overages falling on the City, selling the property for $1 versus providing Tax <br />Increment Financing (TIF) or other options, purchase agreement requirements/process and <br />developer agreement requirements/process, lumber prices, etc. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the <br />Purchase Agreement with Centra North, LLC as presented. <br /> <br />Council Member King asked if this items was to be discussed at the Closed Executive Session <br />scheduled for later in the meeting. Mayor Love stated that a motion and a second have been <br />received to approve the item and the Closed Executive Session was placed on the Agenda only if <br />needed to discuss the item further. <br /> <br />Discussion ensued regarding serving the individuals of the City with several of them addressing <br />the Planning & Zoning Commission and Council with their opposition to the project, difficult <br />decisions, previous guidelines and policies (Downtown Redevelopment Plan), (Comprehensive <br />Plan) and Requests for Proposals (RFPs) for the site. <br />Page 2 of 5 <br /> <br /> <br />
