City of Centerville <br />Council Meeting Minutes <br />September 8, 2021 <br /> <br />Mayor Love provided an opportunity for the Council to add or remove any item(s) to/from the <br />Consent Agenda. Council Members Koski and King acknowledged the importance of Constitution <br />Week. Mayor Love recognized Suicide Prevention month. <br /> <br />Motion by Council Member Koski, seconded by Council Member King to the Approve <br />Consent Agenda as Presented. All in favor. Motion carried. <br /> <br />VIII. OLD BUSINESS <br /> <br />1. None <br /> <br />IX. NEW BUSINESS <br /> <br />1. Old Mill Estates – Trail Construction <br /> <br />Administrator Statz reviewed the history of the project, stated that trail easements were set through <br />the development progression (preliminary plat, final plat, Developer’s Agreement, etc.) He stated <br />that the home was enlarged and not accurately placed on the readied building pad accordingly. He <br />explained that the building pad was set by 30 feet from the front property line and 10 feet from <br />each side lot line. He stated that the trail is approximately 6 to 7 feet from the Palmer’s property. <br />Administrator Statz pointed out the trail was not a late addition and part of closing documents <br />when the owners purchased the property. He stated that the development plan calls for an 8 foot <br />trail with a 4 foot retaining wall. The trail continues through lot 8 along the road into Acorn Creek <br />Park where a parking lot was just completed along with the City’s portion of a trail to the <br />development. Administrator Statz explained as of early 2021, the trail has not been constructed. <br />Administrator Statz stated that he had added email conversations to the packet for Council review. <br /> <br />Mr. Mike Palmer, 1844 Old Mill Road, discussed the planned 8 foot trail that abuts with an <br />easement on his property and its close proximity to his home. He is concerned about pedestrian <br />traffic, privacy, safety of his air conditioning unit/gas meter/exterior equipment and general safety <br />for his family. He also stated he has a signed petition by many of the residents on Old Mill Court. <br />He thanked the City Council for listening to his concerns. Administrator Statz stated all but one <br />property owner signed the petition presented. <br /> <br />Council Member Lakso welcomed him to Centerville. She discussed the hard work that goes into <br />the planning phases of a development, the City’s goals of connectivity of trails though <br />developments and all of its parks. Discussion ensued regarding decreasing the width of the trail <br />from 8 feet to 5 feet, making a minimal maintenance trail, City cleaning equipment being of 8 feet <br />in width for snow removal, having the homeowner be responsible for snow removal as a condition <br />for moving/decreasing the width, working with the developer regarding their monetary <br />contribution for the agreed upon trail to assisting in relocation of a bridge/boardwalk within the <br />nearby wetland, the City not having a contractual right to install a bridge or boardwalk in place of <br />a trail that was previously approved by both the Planning & Zoning Commission, Council and the <br />developer, the City not being responsible for the purchase of the property or any deception <br />associated with the location of the trail easement and construction of a privacy fence on the <br />homeowners property. Discussion continued regarding representation of all Centerville residents, <br />the Developer’s responsibilities to complete required duties within the development per the <br />Page 3 of 6 <br /> <br /> <br />
