March 1, 2022 <br />Centerville Planning & Zoning Commission <br />Page 5 of 5 <br />RE: Max Storage Ï Conditional Use Permit, Site Plan <br />9) Cooking of food, other than for the personal consumption of tenants of the buildings is not <br />allowed on site, and no sale of food to the public is allowed on site. <br /> <br />10) All service or repair of vehicles and equipment must be conducted completely within the <br />enclosed buildings, and then only for vehicles and equipment owned or leased by the <br />tenants in the course of their business. Vehicle repair or maintenance for non-tenants is not <br />allowed. <br /> <br />11) The lighting plan will be revised to add lights at the north and south ends of the building, for <br />review and approval by the City Engineer utilizing all downcast cutoff type fixtures that <br />allow no more than 1 footcandle of light spillage over the property lines. <br /> <br />12) Signage for the building and site will be applied for separately, to be reviewed and <br />approved per City sign standards. <br /> <br />13) If any of the individual storage units are converted to condominium ownership the City will <br />require a plat of the property to reflect the new ownership and reserves the right to review <br />and approve the association documents. This will need further exploration and discussion. <br /> <br />14) Users of the Subject Property will produce no noise, vibrations, air pollution, light pollution, <br />fire hazards or noxious emissions which will disturb or endanger neighboring properties. <br /> <br />15) Users of the Subject Property will create no act of public nuisance or disorderly conduct, as <br />defined pursuant to the CityÔs Code of Ordinances or pursuant to State Law. <br /> <br />16) Users of the Subject Property will follow the applicable standards and requirements of the <br />City of Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp of <br />Engineers, Federal Emergency Management Agency, Minnesota Department of Natural <br />Resources, and any other agency having jurisdiction over the Subject Property. <br /> <br />17) Landowner and Users will obey all laws and regulation necessary to operate a business on <br />the Subject Property, and will obtain and maintain, in good standing, all licenses or permits <br />necessary to operate this type of facility. <br /> <br />18) The Landowner is responsible for all of the conditions set forth in this Permit. <br /> <br />19) In addition to all civil penalties and remedies for violation of this Permit, violation of this <br />Permit is a misdemeanor criminal offense. <br /> <br />60-DAY RULE <br />The applications for CUP and Site Plan were received on January 5, 2022. Final deadline for action <br />by the City per Minnesota Statutes 15.99 on both requests was March 7, 2022, which the City <br />extended an additional 60 days to May 6, 2022. <br /> <br /> <br />
