March 1, 2022 <br />Centerville Planning & Zoning Commission <br />Page 4 of 5 <br />RE: Max Storage Ï Conditional Use Permit, Site Plan <br />Rental vs. Ownership <br />The units are presented now as rental or lease, but it is possible the buildings and property could <br />be converted to condominium ownership in the future, as is not uncommon (the property <br />immediately south of this parcel, at 2005 Gateway Circle, is a condominium with two owners in <br />one building). The CUP runs with the land, but if there are multiple owners on one parcel of land it <br />is not clear how the City might handle this, should one of the units need its own CUP. This warrants <br />further discussion. <br /> <br />RECOMMENDATION <br />I recommend approval of the Conditional Use Permit and Site Plan for Max Storage as depicted <br />on the plans submitted with the following conditions: <br />1) Uses permitted within the units on site are storage inside the building or any Permitted Use <br />in the I-1 zoning district. <br /> <br />2) If a use is proposed for any unit that is allowed by Conditional Use Permit (CUP) in the I-1 <br />zoning district the property owner will need to apply to the City for a CUP on their behalf. If <br />approved, any conditions attached to that use will run with the land and the CUP that is <br />recorded with the property. <br /> <br />3) The property owner will notify the City of any change in use in any of the units and a <br />determination will be made if the use is permitted or not. If permitted by CUP, as noted <br />above, then the CUP process must be followed before that user can occupy the unit. <br /> <br />4) All goods, materials, and equipment must be stored completely within the enclosed <br />buildings. No outside storage is allowed, except for vehicles owned and used by the <br />tenants or owners of the units which may be parked overnight in approved parking <br />spaces. <br /> <br />5) No residential use or living in the units overnight is allowed. <br /> <br />6) Parking on site will be managed by the owner. Parking is allowed only on the designated <br />sites on the approved site plan. No parking is allowed on the City streets or in the drive <br />aisles on site. If there are parking problems on site, as determined by the City Council, the <br />City reserves the right to review and potentially revoke the CUP for the property until a <br />solution can be reached acceptable to the City Council. <br /> <br />7) All trash handling will be inside the buildings. If outside trash cans or dumpsters are to be <br />proposed they must be enclosed within a structure of similar material and appearance as <br />the buildings, to be reviewed and approved by the City Engineer. <br /> <br />8) No outdoor sales or display of goods or materials is allowed. <br /> <br /> <br />
