All current and future site development of the Land <br />shall be in accordance with the Plans and in accordance with the Final Plat, except for subsequent <br />plan revisions, modifications, or amendments approved, in writing, by the City Engineer. <br /> 6. PUBLIC AND PRIVATE IMPROVEMENTS. The Owner shall install and pay <br />for the following Public Improvements (“Public Improvements”) as required by the Development <br />Plans. These Public Improvements are detailed in Exhibit D. <br /> All Public Improvements shall be installed in accordance with the approved Plans, the <br />City’s subdivision ordinance; City standard specifications for utilities and street construction; and <br />any other applicable law or ordinance. The Owner shall submit plans and specifications for the <br />Public Improvements that have been prepared by a licensed registered professional civil engineer <br />to the City for approval by the City Council. The Owner shall obtain all necessary permits from <br />other agencies having jurisdiction over the Land before proceeding with construction of the Public <br />Improvements. The Owner, at its sole expense, shall instruct its engineer to provide adequate field <br />inspection personnel to assure an acceptable level of quality control to the extent that the Owner’s <br />engineer will be able to certify, as a condition of City acceptance, that the construction work for <br />the Public Improvements meet the approved City standards. <br /> The Owner, its contractors, and subcontractors, shall follow all instructions received from <br />the City and Rice Creek Watershed inspectors, so long as in conformity with the Development <br />Plans. The Owner’s engineer shall provide for on-site project management.
