10) An Interim Use Permit could be renewed annually on the condition that the <br />applicant demonstrates their intention toward seeking an operating license for a <br />16-unit senior living/memory care facility. Once kensure to operate the facility is <br />granted, the City can observe the facility in operation in order to examine its <br />concerns related to consumption of emergency services. The Commission felt that <br />one year would be a reasonable period of observation_ Thereafter, the applicant <br />must apply for a Conditional Use Permit from the City if it wishes to obtain a <br />permanent permit to operate its facility, <br />11) The project as proposed meets the criteria for granting an Interim Use Permit in <br />Section 156.330(C)(2) of the Zoning Code. <br />INTERIM USE PERMIT CONDITIONS <br />The City of Centerville hereby grants the Landowner an INTERIM USE PERMIT to <br />develop, construct, and operate a 16-unit senior living/memory care facility subject to <br />the following conditions: <br />1) Landowner will obey all laws and regulation necessary to operate this type of <br />facility, and will obtain and maintain, in good standing, all licenses necessary to <br />operate this type of facility. <br />2) The Landowner will have a sufficient number of trained personnel at the facility at <br />all times who are capable to perform lift assists and will follow the protocol as set <br />forth in Policy 2.05, Fall Protocol, submitted with the permit application. The facility <br />will also comply with additional emergency policies submitted with the <br />application including Policy 1.19 and 2.04. These, and all policies submitted during <br />the application process are incorporated herein. Strict adherence to these <br />policies is a condition of this Permit. Any change to these policies must be <br />approved by the City in writing. Under no circumstances may the facility operate <br />in a manner requiring staff to call for emergency services in the event of all lift <br />assists. <br />3) Users of the Subject Property will produce no noise, vibrations, air pollution, light <br />pollution, fire hazards or noxious emissions which will disturb or endanger <br />neighboring properties. <br />4) Users of the Subject Property will create no act of public nuisance or disorderly <br />conduct, as defined pursuant to the City's Code of Ordinances or pursuant to <br />State Law. <br />5) Users of the Subject Property are encouraged to call for emergency services to <br />the Subject Property. The City is using the period of this interim use to evaluate the <br />nature of calls for emergency services used by the facility operating at the Subject <br />Property. If the nature of those calls becomes excessive, at such time as the <br />Landowner may apply for a Conditional Use Permit, the City may consider such <br />action as, but not limited to, imposing conditions on the Landowner to <br />compensate the City for excessive calls for emergency services, or it may deny <br />K3 <br />
