PERSON. An individual, partnership, corporation, limited liability company, joint venture, trust, <br />association or any other legal entity, however organized. <br /> <br />PLEDGED GOODS. Tangible personal property other than chooses in action, securities, bank drafts or <br />printed evidence of indebtedness that are purchased by, deposited with or otherwise actually delivered <br />into the possession of a pawnbroker in connection with a pawn transaction. <br /> <br />SECONDHAND GOODS DEALER. A person engaged in the business of buying or selling <br />secondhand goods of any kind (excluding motor vehicles), but not including used goods and <br />merchandise taken as part or full payment for new goods and merchandise. <br /> <br />Ord. #64, adopted 08/13/1997 <br /> <br />§ 112.02 LICENSES REQUIRED. <br /> <br />(A) Generally. <br /> <br />(1) No person shall exercise, carry on or be engaged in the trade or business of a pawnbroker, <br />precious metal dealer or Class A or Class B secondhand goods dealer within the city unless the <br />person is currently licensed as provided in this chapter. <br /> <br />(2) A license shall be issued by the City Council for a term ending December 31 of the year issued. <br /> <br />(3) A single license may be issued to a corporation, limited liability company or partnership <br />covering all of its employees or agents; provided, however, that the requirement of this chapter <br />for a bond is provided for an individual who will act as a pawnbroker or secondhand goods <br />dealer. The city shall issue one license and the license shall be reviewed annually. <br /> <br />(B) Exemptions. Pawnbrokers and secondhand goods dealers shall not apply to or include the following: <br /> <br />(1) The sale of secondhand goods where all of the following are present: <br /> <br />(a) The sale is held on property occupied as a dwelling by the seller, or owned, rented or <br />leased by a charitable or political organization; <br /> <br />(b) That no sale exceeds a period of 72 consecutive hours; <br /> <br />(c) The items offered for sale are owned by the occupant; <br /> <br />(d) No more than four sales are held in any 12-month period; and <br /> <br />(e) None of the items offered for sale have been purchased for resale or received on <br />consignment for purpose of resale. <br /> <br />(2) The sale of secondhand books or magazines, sport trading cards, sound or video recordings, or <br />films; <br />169tğŭĻ <br /> <br />
