§ 112.05 INVESTIGATIONS. <br />(A) Preliminary investigation. The city, prior to the granting of an initial or renewed pawnbroker or <br />secondhand goods dealer license, must conduct a preliminary background and financial investigation of <br />the applicant. Any person having a beneficial interest in the license must be investigated. The <br />investigation shall be conducted by the Chief of Police and the results reported to the City Council. The <br />Chief of Police or his or her designee must verify the facts stated in the application, and must report all <br />convicted violations of any state laws, federal laws or municipal ordinances involving the applicant, <br />interested persons or the licensed premises while under the applicantÓs proprietorship. <br /> <br />(B) Fee. The fee charged by the city to an applicant for the cost of investigation is established by the City <br />Council. At the time of each original application for a license, the applicant shall each pay a minimum <br />investigation fee as set by the City Council from time to time. This investigation fee shall not be subject <br />to refund. If the expenses of the investigation exceeds the fee which the city deems necessary to <br />complete the cityÓs investigation of the applicant, the applicant shall pay an additional investigation fee <br />within a five-day period, or the city shall discontinue consideration of the application. Nonpayment of <br />any additional investigation fees required shall be grounds for denial of the application. <br /> <br />(C) Inspections. A peace officer or any properly designated employee of the city or state may enter and <br />search business premises licensed under this section during business hours without a warrant. <br /> <br />Penalty, see § 112.99 <br /> <br />Ord. #64, adopted 08/13/1997 <br />§ 112.06 PUBLIC HEARING. <br /> <br />(A) A pawnbroker or secondhand goods dealer license will not be issued or renewed without a public <br />hearing. Any person having an interest in or who will be affected by the proposed license will be <br />permitted to testify at the hearing. <br /> <br />(B) The public hearing must be preceded by at least ten daysÓ published notice specifying the location of the <br />proposed licensed business premises. <br />Ord. #64, adopted 08/13/1997 <br />§ 112.07 PERSONS AND PLACES INELIGIBLE FOR LICENSES. <br />(A) Persons.
