CHAPTER32:GENERALAUTHORIZATION <br /> Section <br /> 32.01 Background Investigations <br />§ 32.01 BACKGROUND INVESTIGATIONS <br />(A) The purpose of this section is to authorize the City of Centerville acting through a Police Department to <br />access through the Bureau of Criminal Apprehension, Minnesota Computerized Criminal history public <br />data and driverÓs license history background checks on employees, applicants for employment, <br />volunteers and applicants for any license issued by the City, including but not limited to licenses for <br />intoxicating liquor, wine, beer, refuse haulers, tobacco, peddler, solicitor and massage. The City may <br />conduct comprehensive background investigations, including but not limited to accessing data through <br />other automated and non-automated sources and contacting references. The City may periodically <br />conduct a driverÓs license inquiry upon employees, volunteers or licensees where possession of a valid <br />driverÓs license is an essential qualification of the position or license. Before the investigation is <br />undertaken, the person must authorize the Police Department in writing to undertake the investigation <br />and to release the information to the City Administrator, and other City staff as appropriate. If a <br />questioned identity situation occurs, fingerprint or other biometric verification shall be obtained. <br /> <br />(B) Should the City reject an applicantÓs request for employment due, partially or solely, to the applicantÓs <br />prior conviction of a crime, subject to the exception set forth in Minnesota Statutes Section 364.09, the <br />City Administrator shall notify the applicant in writing of the following: <br /> <br />(1) The grounds and reasons for the denial; <br /> <br />(2) The applicable complaint and grievance procedure set forth in Minnesota Statutes Section <br />364.06; <br /> <br />(3) The earliest date the applicant may reapply for employment; and <br /> <br />(4) All competent evidence of rehabilitation will be considered upon reapplication. <br /> <br />Ord. 2d #23, adopted 12/10/2008 <br />23 ΋tğŭĻ <br /> <br />
