Attorney Glasser suggested using language that nearby cities <br />have and filling in the variables; for example, the city could add language that bans hunting, except <br />on the lake or parcel greater than 40 acres and with the owner’s permission; an overlay to this could <br />be that there must be a 750 ft radius from structure, parks public land or right-of-way or boundary <br />to a parcel. Attorney Glasser mentioned looking at the City of Lino Lakes’ language to ensure <br />consistency in regulations with the Department of Natural Resources (DNR), noting that this could <br />make enforcement easier. <br />Chair Kubat reviewed that the Board would like to continue supporting hunting on the lakes, not in <br />an agricultural area. There is also a consensus for a prohibition related to distance from lot lines and <br />structures. Finally there is consensus to use the State Statute for archery, muzzle loader and firearms. <br />Attorney Glasser will revise the ordinance and this item will be brought back to the P&Z for further <br />discussion. <br />VII. NEW BUSINESS <br />1.Fence Plan Revisions – Amazon <br />This item was discussed out of order, before Old Business. Administrator Statz introduced this item, <br />noting that Amazon is requesting a variation in their fence plan. Amazon would like to install barbed <br />wire on top of the 8ft security fence for the truck court. The City Code prohibits barbed wire and <br />electric fences, except in the R-1 District and then may only be used in conjunction with agricultural <br />activities. Also, fencing in commercial/industrial zoning districts shall not exceed 8 ft in height. A <br />PUD allows some flexibility. Discussion ensued and members had mixed opinions about whether <br />to amend the PUD. Reasons include aesthetics and safety. The representative for Amazon will take <br />feedback received back to Amazon. No formal motion was made by the P&Z at this time. <br />VIII. APPROVAL OF MINUTES <br />1.September 13, 2022 Planning & Zoning Commission Meeting Minutes <br />The minutes were tabled because the section on the discharge of firearms was not included in them. <br />The minutes will be revised and then brought back for approval. <br />Motion by Chair Kubat, seconded by Commissioner Thompson to table the September 13, <br />2022 Planning and Zoning Commission minutes to amend them to include the discussion on <br />the Discharge of Firearms. All in favor. Motion carried. <br />IX. Announcements and Updates <br />1.Council Member Liaison <br />Councilmember Koski reported that it is budget time and the city just approved a 3.7% levy increase <br />for 2023. The increase is due to public safety and the loss of Local Government Aid (LGA). <br />2.Administrator’s Report <br />City Administrator Statz reviewed the administrator’s report as presented, highlighting that <br />voting participation is good – there have been about thirty (30) people so far. Administrator Statz <br />also announced board vacancies and upcoming events: Trunk or Treat, Volunteer Appreciation, and <br />Veterans Day.
